景德镇陶瓷知识产权保护存在问题和对策研究

【摘要】：自加入世界贸易组织以来,我国经济发展持续稳步发展,科技创新水平不断攀升,同时在面对国际间的贸易竞争时,我国企业越来越多的意识到,知识产权已成为限制自身发展走向国际化的一个重要因素,我国也已经认识到发展知识产权对于提高国际竞争力的重要意义。2016年,国务院办公厅发布了《知识产权综合管理改革试点总体方案》,从国家层面出发,对我国各地方政府在推行知识产权制度中出现的管理体制不完善、保护程序不够严格、服务的能力和水平不高、推进创新驱动的支持和鼓励上缺乏行之有效的政策等突出问题,提出了有针对性和可操作性的指导意见。景德镇作为一个享誉中外的“瓷都”,拥有上千年制瓷历史,制瓷业一直是当地发展的支柱产业,其手工制瓷技艺始终延续没有断层,得到了很好的传承和保留,而在当今这个以科技创新为主导的时代,如何在传统和创新之间保持平衡,取得最好的发展效果,这正是景德镇陶瓷企业在生存和发展壮大中面临的问题。作为政府,在规范陶瓷行业秩序的过程中,面对在实际管理中出现的一系列知识产权问题如:知识产权在企业的重视度不高;侵权的打击力度不大、效果不好;各部门的利益协调和配合不一致等。从促进和发展陶瓷行业的目的出发,需要制定完善的知识产权保护制度来鼓励和维护企业的科技创新成果。本文通过阐述知识产权相关概念,在了解和研究一些欧洲发达国家的知识产权管理制度的基础上,结合我国知识产权保护现状,深入调查近年来景德镇陶瓷产业生存和发展的实际情况,通过调查深入细致地分析景德镇在陶瓷行业知识产权保护方面采取的措施、存在的问题、分析问题产生的原因,并以此为依据,从司法保护和行政保护两个方面提出合理有效的建议和对策,为景德镇政府实施陶瓷知识产权保护,促进和发展陶瓷产业提供参考依据。
[Abstract]:Since China's entry into the World Trade Organization (WTO), China's economy has been developing steadily and the level of scientific and technological innovation has been rising. At the same time, in the face of international trade competition, more and more Chinese enterprises have realized that, Intellectual property has become an important factor that limits its development to internationalization. China has also realized the importance of developing intellectual property to improve international competitiveness. In 2016, The General Office of the State Council has issued the "General pilot Plan for the Comprehensive Management of intellectual property Rights", which, proceeding from the national level, is not perfect enough in the management system and the procedures for the protection of the intellectual property rights that appear in the implementation of the intellectual property system by various local governments in China. Such outstanding problems as the low capacity and level of services, the lack of effective policies to promote innovation-driven support and incentives, As a famous "porcelain capital" in China and abroad, Jingdezhen has a history of making porcelain for thousands of years, and the porcelain industry has always been the pillar industry of local development. Has been well inherited and preserved, and in this era dominated by scientific and technological innovation, how to maintain a balance between tradition and innovation and achieve the best development results, This is precisely the problem that Jingdezhen ceramic enterprises face in their survival and development. As a government, in the process of standardizing the order of the ceramic industry, In the face of a series of intellectual property problems in the actual management such as: intellectual property rights in the enterprise attention is not high, the impact of infringement is not strong, the effect is not good; For the purpose of promoting and developing the ceramic industry, It is necessary to establish a perfect intellectual property protection system to encourage and safeguard the scientific and technological innovation achievements of enterprises. This paper expounds the concepts related to intellectual property rights, and on the basis of understanding and studying the intellectual property management systems of some European developed countries, Combined with the current situation of intellectual property protection in China, the actual situation of the existence and development of Jingdezhen ceramic industry in recent years is investigated in depth, and the measures and existing problems in the protection of intellectual property rights of Jingdezhen are analyzed deeply and meticulously through the investigation. Based on the analysis of the causes of the problems, this paper puts forward some reasonable and effective suggestions and countermeasures from the aspects of judicial protection and administrative protection, which provides a reference for Jingdezhen government to implement the protection of ceramic intellectual property rights and to promote and develop the ceramic industry.
