深圳市城市更新若干法律问题研究

【摘要】:城市在持续发展之后,普遍会遇到一个所谓的“瓶颈”阶段,在这个阶段,不论是它的基础设施或者城市的功能,都没有办法负担城市下阶段持续健康发展的需要,因此这个时候这个城市或者说这个城市的部分区域即有进行更新改造的必要。而城市更新的目的,在于通过城市更新的种种手段,使得城市中的不良地区得以改善,以提高居民的居住品质和水准。本文专门针对深圳市城市更新的具体实践出现的现象及问题,进行研究。本文除却引言及结语两个部分,总共可分为四大部分。第一章是对深圳市城市更新制度总体进行解构,首先介绍了深圳市土地国有化转制、用地紧张及存量土地成为深圳市城市土地供应的主要来源的制度背景,其后从构建土地增值收益分配和土地所有权转变机制,引入市场化操作的角度进行制度总体解构,最后对制度实施几年以来取得的成果总结和制度不足进行反思,其带来了更新区域环境的改善和居住品质的提高,供应了城市发展所需的土地,增加了投资拉动了经济增长的成果,但是在其实施中也产生了种种不足和问题,从而引出以下三章的内容。第二章是对深圳市城市更新容积管理机制的研究,首先介绍了深圳市城市更新项目普遍存在的高容积、高楼层的现象,引出对城市更新过程中容积率这个问题的分析,在其后详细介绍了美国城市土地管理思维和容积管理措施在城市土地管理中的应用这一理论,最后据此对我国容积调整管理机制和深圳市城市更新中的容积管理机制进行反思、提出改善意见。第三章是对深圳市城市更新封锁效力机制的研究,首先介绍的是在城市更新范围确定的前后,往往会出现投资客对拆迁房的炒作和业主对拆迁房的抢建等与后期城市更新目的不相吻合的干扰行为这样一种现象及引发的问题,其后是对在这一领域相对实践时间较长和法制较完善的德国法制的介绍,最后是就在深圳市城市更新构建起这样一种切实可行的封锁效力机制的构想。第四章是对深圳市城市更新中公权力是否应该介入市场化运作中的深圳市城市更新拆迁过程的研究,本章在总结其他国家和地区的经验上,得出公权力应该以合理的方式适当介入拆迁。
[Abstract]:After sustained development, cities generally encounter a so-called "bottleneck" stage, in which neither their infrastructure nor the city's functions can afford the need for sustainable and healthy development in the next phase of the city.Therefore, at this time, the city or part of the city is necessary to be renovated.The purpose of urban renewal is to improve the poor areas of the city through various means of urban renewal in order to improve the residents' living quality and standard.This paper focuses on the phenomena and problems in the practice of urban renewal in Shenzhen.Apart from the introduction and conclusion, this article can be divided into four parts.The first chapter is to deconstruct the urban renewal system of Shenzhen City. Firstly, it introduces the system background of the nationalization and transformation of Shenzhen's land, the shortage of land and the stock of land as the main source of urban land supply in Shenzhen.After that, from the perspective of constructing the mechanism of land value-added income distribution and land ownership transformation, the system is deconstructed in general from the perspective of market-oriented operation. Finally, it reflects on the achievements made in the implementation of the system in the past few years and the insufficiency of the system.It has brought about the improvement of the regional environment and the improvement of the living quality, provided the land needed for the urban development, increased the results of the investment to stimulate the economic growth, but also produced various shortcomings and problems in its implementation.Thus leads to the contents of the following three chapters.The second chapter is the research of Shenzhen city renewal volume management mechanism. Firstly, it introduces the phenomenon of high volume and high floor in Shenzhen city renewal project, which leads to the analysis of the problem of volume rate in the process of city renewal.After that, the author introduces the theory of the thinking of urban land management and the application of volume management measures in urban land management in the United States in detail. Finally, it reflects on the management mechanism of volume adjustment in China and the volume management mechanism in urban renewal in Shenzhen.Put forward suggestions for improvement.The third chapter is a study on the effectiveness of urban renewal blockade in Shenzhen. First of all, it introduces the scope of urban renewal before and after the determination.There is often a phenomenon and the problem caused by the phenomenon that the speculation of the investors on the demolition of the house and the building of the demolition house by the owners do not coincide with the purpose of the urban renewal in the later period.Then it introduces the German legal system, which is relatively long in practice and perfect in legal system in this field. Finally, the idea of constructing such a feasible blockade mechanism in Shenzhen city is put forward.The fourth chapter is a study on whether the public power should be involved in the process of urban renewal and demolition in the market operation of Shenzhen. This chapter summarizes the experiences of other countries and regions.Public power should be properly involved in demolition in a reasonable manner.
