施工合同管理风险防范及应用

【摘要】:随着房地产市场的迅猛发展及基建设施的不断更新发展。建设工程施工活动异常活跃,新问题也层出不穷。然而,合同体系不健全,合同管理水平低,在建筑市场仍然普遍存在。作为在建筑市场起重要作用的《建设工程施工合同示范文本》的发展已经跟不上时代发展的步伐。通过对示范合同09版至11版的分析,作者发现,这些版本的改进,实质性的改进不多,对于建设工程施工过程中遇到的很多问题都没有涉及。而建设工程施工合同涉及面广,标的额大,影响范围广,同时建设工程施工过程中又会不断遇到很多新问题,而相应的解决办法却没有相应的法律依据。如:工程签证、总分包配合与协调、样板房制度等。因此对于新发现的问题及解决办法有必要在合同中明确解决办法。本文通过大量工程实践,对工程施工过程常见的问题进行分析,提出相应的解决办法,将这些问题上升到合同条文角度,从而给参建主体带来约束力,避免施工过程中产生扯皮现象。在此基础上作者提出了《新型建设工程施工合同示范文本》。通过在作者经过的几个工程项目的应用与实践,新型《新型建设工程施工合同示范文本》规避了很多合同风险,为开发商和施工单位节约了成本,避免工期延误,取得了相应的经济效益和社会效益。
[Abstract]:With the rapid development of the real estate market and the continuous development of infrastructure. Construction activities are extremely active, and new problems emerge in endlessly. However, the contract system is not perfect and the level of contract management is low. As an important role in the construction market, the construction contract model text has been unable to keep pace with the development of the times. Through the analysis of the model contract from edition 09 to edition 11, the author finds that the improvement of these versions and the substantial improvement are not many, which are not involved in many problems encountered in the construction process of the construction project. The construction contract of construction project involves a wide range, the target amount is large, the scope of influence is wide, at the same time, during the construction process of the construction project, there will be a lot of new problems, but the corresponding solution does not have the corresponding legal basis. Such as: project visa, total sub-package coordination and coordination, model housing system and so on. Therefore, it is necessary to resolve the newly discovered problems and solutions in the contract. Through a large number of engineering practices, this paper analyzes the common problems in the construction process of the project, puts forward corresponding solutions, and raises these problems to the angle of the contract provisions, thus bringing binding force to the participants in the construction. Avoid the phenomenon of ripping in the construction process. On this basis, the author puts forward the model text of the new construction contract. Through the application and practice of several engineering projects passed by the author, the new model text of construction contract of new type construction project evades many contract risks, saves the cost for developers and construction units, and avoids the delay of construction period. The corresponding economic and social benefits have been obtained.
