我国城乡规划法规标准体系建设及优化策略

【摘要】：本文从城乡规划的行政行为、技术行为和社会行为3种属性出发,梳理城乡规划法制化的核心环节—法规标准体系建设从新中国成立至今所经历的阶段,剖析现行城乡规划法规标准体系存在的疏于优化管理、实用性不足和公共政策属性弱等问题,借鉴国内外学者的理论研究成果和发达地区的成功经验,从强化行政依据、完善技术标准和提升社会效应三方面着手,探索城乡规划法规标准体系优化的策略,并以南京市的实践阐释如何具体实施这些优化策略。
[Abstract]:Starting from the three attributes of administrative behavior, technical behavior and social behavior of urban and rural planning, this paper combs the key link of urban-rural planning legalization-the construction of the legal standard system of urban and rural planning, which has been going through since the founding of New China. This paper analyzes the problems existing in the current system of urban and rural planning laws and regulations, such as the lack of optimal management, the lack of practicability and the weak attributes of public policies, and draws lessons from the theoretical research results of scholars at home and abroad and the successful experiences of developed regions to strengthen the administrative basis. From the three aspects of perfecting technical standard and promoting social effect, this paper explores the strategies of optimizing the standard system of urban and rural planning laws and regulations, and explains how to carry out these optimization strategies in practice in Nanjing.
