基于2013版清单计价规范的发包人索赔管理研究

【摘要】:我国的建筑业正在飞速发展,随着施工难度的提高、施工技术的日益复杂、工程规模的日益扩大等,工程的不可预测因素不断增加,工程索赔变得更加频繁、更加复杂。2013版工程量清单计价规范实行后,工程造价管理又面临着新的要求,工程索赔管理也面临新的形势。在索赔管理上,承包人比发包人更为专业,有经验的承包人擅长通过低价策略赢得中标,再利用工程索赔获得高额的利润,面对经验丰富、专业技术强的承包人,加上新的2013版工程量清单计价规范环境,当前发包人的工程索赔管理任务艰巨。基于以上背景,本文研究2013版工程量清单计价规范下的发包人工程索赔管理。 首先通过文献查阅总结和比较研究的方式,简述了国内外对工程索赔的研究现状,分析了2013版工程量清单计价规范给工程造价管理带来的变革。 通过讨论发包人索赔管理的内容、步骤、策略、不足,,分析2013版工程量清单计价规范有关索赔的规定,将发包人索赔管理研究的重心放在预防承包人索赔和处理承包人提出的索赔两个方面。 在索赔预防研究中,以2013版清单计价规范和2013施工合同示范文本为根据,全面排查承包人的索赔机会点和不平衡报价机会点,逐条制订了预防策略,根据全过程管理的思想,归纳总结出发包人全过程的索赔预防策略。 从索赔谈判的准备和谈判博弈两个方面研究了发包人索赔的处理,通过定性研究阐述了索赔谈判的准备工作,运用博弈论和贝叶斯理论建立了索赔处理谈判的模型,用于对索赔谈判出价进行量化分析。 通过工程实证分析,表明在2013版清单计价规范下,本文提出的全过程索赔预防策略可有效的预防索赔的发生,索赔处理模型可在索赔谈判实践中取得了良好的效果。
[Abstract]:The construction industry of our country is developing at full speed. With the increasing difficulty of construction, the increasingly complex construction technology, the increasing expansion of engineering scale and so on, the unpredictable factors of engineering are increasing, and the claim for compensation becomes more frequent. After the implementation of the valuation standard of the 2013 edition of the bill of quantities, the project cost management is facing new requirements, and the project claim management is also facing a new situation. In claim management, the contractor is more professional than the contractor. The experienced contractor is good at winning the bid through the low price strategy, then using the project claim to obtain high profits, facing the experienced, professional and skilled contractor. In addition to the new 2013 edition of the bill of quantities valuation standard environment, the current contractor's project claim management task is arduous. Based on the above background, this paper studies the contract engineering claim management under the 2013 Bill of quantities valuation specification. Firstly, through the way of literature review and comparative study, the research status of project claim at home and abroad is briefly described, and the reform of engineering cost management brought by 2013 edition of bill of quantities valuation standard is analyzed. By discussing the contents, steps, strategies, and deficiencies of the contractor's claim management, this paper analyzes the requirements of the valuation standard of the 2013 edition of the bill of quantities for the claims concerned. This paper focuses on the prevention of contractor claims and the handling of contractor claims. In the study of claim prevention, based on the 2013 edition list valuation specification and the 2013 construction contract model text, the contractor's claim opportunity point and unbalanced quotation opportunity point are comprehensively checked, and the prevention strategy is formulated one by one, according to the idea of whole process management. Sum up the whole process of the contractor claims prevention strategy. From two aspects of claim negotiation preparation and negotiation game, this paper studies the processing of the contract's claim, expounds the preparation of claim negotiation by qualitative research, and establishes the model of claim processing negotiation by using game theory and Bayesian theory. For quantitative analysis of claim negotiation bids. Through the engineering empirical analysis, it is shown that the full process claim prevention strategy proposed in this paper can effectively prevent the occurrence of claims under the specification of list valuation in version 2013, and the claim processing model can achieve good results in the practice of claim negotiation.
