我国信托公司的治理及其监管研究

【摘要】：信托是与银行、证券、保险同等重要的金融四大产业之一。信托具有其它三大产业所不具备的在资金融通、投资理财、财产管理和社会公益等领域的金融服务功能,是金融体系不可或缺的一个重要部分。改进和完善我国信托体系,也是我国金融体制改革的内容之一。此外,信托业对于国民经济的推动作用也是不言而喻的,尤其是对于我国这样一个正在处于高速发展阶段,且经济社会结构正在不断转型的国家。信托业自身的发展情况和信托业相关法律法规及配套制度的完善,都会对我国经济社会的发展起到很大的帮助作用。本文以公司治理理论和金融监管理论为理论基础,主要针对我国信托业发展过程中存在的公司治理效率低下和监管欠合理问题,在充分借鉴国内外信托业经营管理效率研究成果的基础上选取符合我国国情的信托投入产出指标,根据历史相关数据,利用数据包络分析方法,对我国信托业的经营管理效率进行测算和评价,并在借鉴欧美发达国家信托监管模式及其我国海南信托业失败的经验的基础上对我国信托监管体系进行分析和研究,提出提高信托公司治理效率和监管水平的措施。
[Abstract]:Trust is one of the four financial industries, which is equally important as banking, securities and insurance. The function of financial services in the fields of property management and social welfare is an indispensable part of the financial system. Improving and perfecting the trust system is also one of the contents of the reform of our financial system. Trust industry is also self-evident for the promotion of the national economy, especially for our country such a high-speed development stage. The development of trust industry and the perfection of relevant laws and regulations and supporting system will help the development of our country's economy and society. Based on the theory of corporate governance and financial supervision, this paper aims at the problems of low efficiency of corporate governance and unreasonable supervision in the development of trust industry in China. Based on the research results of trust industry management efficiency at home and abroad, the trust input-output index is selected according to the situation of our country. According to the historical data, the method of data envelopment analysis is used. This paper measures and evaluates the management efficiency of trust industry in China. Based on the model of trust supervision in developed countries in Europe and the United States and the experience of the failure of trust industry in Hainan, this paper analyzes and studies the trust supervision system of our country. The measures to improve the efficiency of trust company governance and the level of supervision are put forward.
