后金融危机时代我国金融监管体制改革法律问题研究

【摘要】:这次金融危机深深影响了世界经济的发展,对全球经济造成了巨大损失,也对金融秩序造成了极大的冲击和破坏。金融自由化潮流驱动下,混业经营的加深,金融衍生品的发展使得旧式金融监管体制下积累的系统性风险逐步暴露。于是各国纷纷审视金融监管模式,调整金融监管架构,以求恢复金融市场信心和稳定。 我国较为封闭的监管体制并未像欧美国家受到重创,因此2008年金融危机后我国金融监管体制并未有较大改动。但不得不强调,我国现有的金融监管体制不利于金融创新。改革现有监管体制不仅利于金融业的发展而且适应国际化大趋势。我国金融监管水平较为落后,,学界也缺乏足够的研究,同时往往照搬国外监管模式、脱离我国实际,缺乏本土适应性。本文旨在通过剖析现行金融监管法律框架下暴露出的问题,借鉴发达国家危机后金融监管体制改革,结合我国实际,提出完善我国金融监管法律体制的建议。 本文共分为四部分 第一部分介绍了金融监管的基础理论,明晰后金融危机以及金融监管法律体制的含义;详细对金融监管模式进行分类,为进一步确立我国金融监管模式的选择提供有益借鉴;从经济学角度分析金融监管体制改革的必要性,对我国金融监管体制的选择同样有借鉴意义。 第二部分,以美国、英国、澳大利亚为例,通过对发达国家金融危机前后金融监管法律体制改革的变化,总结出国际金融监管立法改革的新趋势。加强宏观审慎监管,加强对金融消费者的保护,金融监管模式的转变等。 第三部分,回顾了我国金融监管体制的发展历程,阐述了金融危机后我国做出的金融监管体制的改革,分析我国金融监管体制存在的问题,市场开放不足,缺乏有效的信息共享与协调机制等。 第四部分,通过对金融危机前后发达国家金融监管体制的变化,以及我国金融监管体制存在的问题分析,得出适合我国国情的金融监管体制改革路径。初期,完善金融监管协调机制,中长期,基于宏观审慎监管,以及市场行为和金融消费者保护两大目标,建立以目标为导向的双峰监管体制。同时在完善相关法规的同时,构建宏观审慎监管体系,完善金融消费者保护的相关法律法规。
[Abstract]:This financial crisis has deeply affected the development of the world economy, caused enormous losses to the global economy, and caused great impact and destruction to the financial order. Driven by the trend of financial liberalization, the mixed operation deepened. The development of financial derivatives gradually exposes the systemic risks accumulated under the old financial supervision system, so many countries have examined the financial supervision model and adjusted the financial regulatory structure in order to restore the confidence and stability of the financial market. China's relatively closed regulatory system has not been hit as hard as that of Europe and the United States, so there has been no major change in our financial supervision system since the financial crisis in 2008. The current financial supervision system in China is not conducive to financial innovation. The reform of the existing regulatory system is not only conducive to the development of the financial industry but also to the trend of internationalization. The level of financial supervision in China is relatively backward, and the academic community lacks sufficient research. At the same time, the foreign regulatory model is often copied, which is divorced from the reality of our country and lacks local adaptability. This paper aims to learn from the financial supervision system reform after the crisis in developed countries by analyzing the problems exposed under the current legal framework of financial supervision. Combining with the reality of our country, this paper puts forward some suggestions to perfect the legal system of financial supervision in our country. This paper is divided into four parts. The first part introduces the basic theory of financial supervision, clarifies the meaning of post-financial crisis and the legal system of financial supervision, classifies the mode of financial supervision in detail, and provides useful reference for further establishing the choice of financial supervision model in China. The analysis of the necessity of the reform of the financial supervision system from the angle of economics can also be used as a reference for the choice of the financial supervision system in our country. The second part, taking the United States, the United Kingdom and Australia as an example, through the changes in the legal system of financial supervision before and after the financial crisis in developed countries, summarizes the new trend of the legislative reform of international financial supervision, and strengthens macro-prudential supervision. Strengthen the protection of financial consumers, the transformation of financial supervision model. The third part reviews the development course of our country's financial supervision system, expounds the reform of our country's financial supervision system after the financial crisis, analyzes the problems existing in our country's financial supervision system, and the lack of market opening. Lack of effective information sharing and coordination mechanism. In the 4th part, by analyzing the changes in the financial supervision system of developed countries before and after the financial crisis, and the problems existing in the financial supervision system of our country, we get the path of the reform of the financial supervision system suitable for the national conditions of our country. To improve the coordination mechanism of financial supervision, in the medium and long term, and based on the two goals of macro-prudential supervision, market behavior and financial consumer protection, to establish a two-peak goal-oriented regulatory system. At the same time, while perfecting the relevant laws and regulations, Build macroscopical prudential supervision system, perfect the relevant laws and regulations of financial consumer protection.
