【摘要】:支付体系是现代市场经济和金融活动的核心基础设施。安全高效的支付体系是经济金融持续健康发展的重要保障。近十年来,我国第三方支付呈现持续、快速发展的趋势,其业务规模、涉及领域不断扩大;第三方支付与经济金融活动的联系日益紧密,在我国支付体系中的重要性日益增强。在此背景下,本文在系统剖析我国第三方支付发展及监管现状的基础上,基于“市场失灵”理论,论述了对第三方支付实施监管的必要性,并以建立有效监管机制为目标,通过借鉴国外先进监管经验,从有效监管的基本准则、监管框架以及监管指标等方面着手,深入分析和精心设计了适应我国国情的第三方支付有效监管体系,围绕第三方支付有效监管的理论支撑和实践路径进行了全面、系统的研究。主要结论包括:(1)针对不同类型第三方支付机构及其创新产品带来的认知滞后和风险边界判断困难,应以原则性监管为基础,差异性监管为手段,及时、动态调整为策略,以求达到维持市场稳定和平衡各方利益的有效监管目标;(2)构建我国第三方支付的有效监管框架需要多维度、综合性地考虑组织架构、监管内容、监管环节、监管方式、监管措施、监管手段等因素;(3)现阶段第三方支付的有效监管应尽快建立起以客户备付金安全为核心,涉及第三方支付机构流动性、偿付能力、收益能力、交易安全、损失弥补等多方面内容的衡量、预警、提示性的监测指标体系,并设计了20余种具体监测指标。 与此前我国第三方支付监管的研究成果相比,本文在分析第三方支付发展历程、存在问题及监管必要性的基础上,采用了从抽象到具体、定性分析与定量分析相结合、规范分析与模型分析相结合、归纳与演绎比较、历史与现实相结合等多种研究方法,从理论和实践两方面,较为全面、系统地对构建一个完整的第三方支付市场监管体系进行了分析与设计。本文的特色和创新主要包括以下方面: (1)按照理论与实务并重的思路,紧密围绕相关制度经济学、西方经济学理论,以指导实际监管工作为目标,从基本准则、总体框架和监管指标等多个方面,首次综合性、系统性地分析和阐述了适用于我国的第三方支付监管体系。 (2)在深入分析、把握第三方支付发展规律的基础上,结合“市场失灵”理论,剖析了第三方支付“市场失灵”的四大来源:公共品、外部性、垄断和不完全竞争,并以外部性为例,详细阐述了对第三方支付实施有效监管的必要性。 (3)详细回顾了第三方支付产生、发展历程,全面介绍了第三方支付各类业务模式及存在的风险点,深入比较了国外第三方支付监管的基本模式与有益经验。本文结合我国第三方支付发展现状,就实施有效监管进行深入剖析,明确提出了有效监管的监管理念,并对有效监管的监管强度、监管重心和监管目标进行了分析,从理论层面提出了第三方支付有效监管的可行条件和实现条件。 (4)初步构建了我国第三方支付有效监管的基本准则、总体框架和基本机制。本文运用博弈论方法分析了第三方支付有效监管的基本准则。本文所设计的第三方支付监管框架适应国情,立足于现阶段第三方支付产业监管的实际情况,对建立和优化我国第三方支付监管体系具有一定的理论和实践指导意义。本文提出并分析了以中央银行法定监管为主,商业银行协作监督为辅,外部监督和内部自律相结合的第三方支付监管框架。本文按照规范与发展并重的监管目标,对我国第三方支付的监管原则、监管模式、重点环节以及监管手段等进行了全面深入的讨论。 (5)针对目前国内第三方支付机构监管的现实和重点,本文围绕客户备付金这一核心问题,设计了适合我国第三方支付机构的备付金存管模式,并根据设计的备付金存管模式,构建了一套务实的第三方支付机构监管指标体系。该指标体系包括反映第三方支付机构资产负债结构、资产质量、安全性、流动性以及盈利性的一系列指标。该指标体系有利于反映第三方支付机构运营状况,也便于监管机构监控其日常运营风险,从而实现对第三方支付机构的定量化监管。
[Abstract]:The payment system is the core infrastructure of the modern market economy and financial activity . The safe and efficient payment system is an important guarantee for the sustained and healthy development of the economy .
( 2 ) To construct the effective regulatory framework of third - party payment in our country requires multiple dimensions , considering the organizational structure , regulatory content , regulatory links , regulatory methods , regulatory measures , regulatory measures and so on ;
( 3 ) The effective supervision of third - party payment shall be established as soon as possible with the security of the client ' s preparation and payment as the core , involving the measurement , early warning and prompt monitoring index system of the liquidity , solvency , profitability , transaction safety and loss compensation of the third - party payment institution , and designs more than 20 specific monitoring indexes .
Compared with previous research results of third - party payment supervision in our country , this paper analyzes and designs a complete third - party payment market supervision system from abstract to concrete , qualitative analysis and quantitative analysis based on the analysis of the development course of third - party payment , the problems and the necessity of supervision .
( 1 ) According to the theory and practice , and closely surround the relevant system economics and the western economics theory , to guide the actual supervision work as the objective , the first comprehensive and systematic analysis and elaboration of the third - party payment supervision system applicable to our country from aspects such as basic criterion , overall framework and supervision index , etc .
( 2 ) On the basis of deeply analyzing and grasping the third - party payment development law , combining the theory of " market failure " , the paper analyzes the four main sources of the third - party payment of " market failure " : public goods , external , monopoly and imperfect competition , and discusses the necessity of effective supervision on third - party payment .
( 3 ) The third party payment generation and development course is reviewed in detail . The third party pays all kinds of business model and the risk points , and compares the basic mode and beneficial experience of third party payment supervision . This paper makes an in - depth analysis on the implementation of effective supervision based on the present situation of third party payment development in our country , and makes an analysis on the supervision intensity , supervision center of gravity and regulatory target of effective supervision , and puts forward the feasible conditions and realization conditions for effective supervision of third party payment .
( 4 ) The basic criterion , the general framework and the basic mechanism of the third - party payment effective supervision in our country are preliminarily constructed . The third - party payment regulatory framework designed by this paper is applicable to the actual situation of the third - party payment supervision system , and the third - party payment regulatory framework combined with the supervision of the third - party payment industry is proposed and analyzed . The article puts forward and analyzes the supervision framework of third - party payment supervision based on the regulation and development of the third party , and discusses the supervision principle , supervision mode , key link and supervision means of third - party payment in our country .
( 5 ) In view of the current situation and focus of the supervision of the third - party payment institution in China , this paper designs a set of pragmatic third - party payment institution supervision index system based on the core issue of the customer ' s reserve payment . The index system includes a series of indicators reflecting the structure of the third - party payment institution , asset quality , safety , liquidity and profitability . The index system is beneficial to reflect the operational status of the third - party payment institution , and also facilitates the supervision and monitoring of the daily operational risk of the third - party payment institution , so as to realize the quantitative supervision of the third - party payment institution .
