我国文化创意产业知识产权保护体系的构建

【摘要】：在世界知识经济大潮的影响下,文化创意产业蓬勃发展,成为各国经济竞争的新着力点。我国文化创意产业正处于开局时期,与发达国家相比,其发展仍存在一些问题。文化创意产业的发展与知识产权保护联系紧密。为发展我国文化创意产业,应建立起适合我国国情的文化创意产业知识产权大保护体系。首先,通过对我国文化创意产业发展情况的最新数据进行分析,结合对各国创意产业发展先进模式的对比研究,进行分析和归纳,得出当前我国文化创意产业的发展趋势及存在的主要问题。其次,探索创意产业与知识产权的相互作用机制,包括激励作用,抑制作用以及倒“U”型关系。再次,在对文化创意产业与知识产权关系进一步理解的基础上,对我国文化创意产业的知识产权保护现状进行概括和总结,分析当前我国文化创意产业存在的制约性问题。最后,结合我国国情,文化创意产业发展现状,知识产权保护现状,以及他国经验,以文化创意产业和知识产权的相互作用机制为理论依据,为文化创意产业知识产权大保护体系的建立划定宏观发展蓝图,根据我国当前文化创意产业发展计划提出的三个时间节点作出三步规划,并以立法、司法、执法三个方面分别对体系构建提出具体性建议。
[Abstract]:Under the influence of the knowledge economy in the world, the cultural and creative industries have developed vigorously and become the new focus of economic competition. China's cultural and creative industries are at the beginning of their development, compared with the developed countries, there are still some problems. The development of cultural and creative industries is closely related to the protection of intellectual property rights. In order to develop China's cultural and creative industries, we should set up a large intellectual property protection system suitable for our country's national conditions. First of all, through the analysis of the latest data on the development of cultural and creative industries in China, combined with the comparative study of the advanced models of the development of creative industries in various countries, The development trend and main problems of cultural and creative industries in China are obtained. Secondly, explore the interaction mechanism between creative industry and intellectual property, including incentive, inhibition and inverted "U" relationship. Thirdly, on the basis of further understanding of the relationship between cultural and creative industries and intellectual property rights, this paper summarizes and summarizes the current situation of intellectual property protection of cultural and creative industries in China, and analyzes the restrictive problems existing in cultural and creative industries in China. Finally, according to the situation of our country, the current situation of cultural and creative industry development, the current situation of intellectual property protection, and the experience of other countries, based on the interaction mechanism between cultural and creative industries and intellectual property rights as the theoretical basis. To draw up a macro development blueprint for the establishment of a big protection system for intellectual property rights of cultural and creative industries, according to the three time points proposed by the current cultural and creative industry development plan in China, and to make a three-step plan by way of legislation and justice. Three aspects of law enforcement put forward concrete suggestions on system construction.
