【摘要】:电子商务作为当今社会发展的一种新型市场交易模式,,在现在生活中得应用越来越广泛,电子商务具有快捷,便利等特点,反映着未来贸易方式的发展方向,在其蓬勃发展的同时,得到了社会的普遍赞同和认可。电子商务市场是现在发展最快,最具潜力的领域,电子商务的迅速发展和应用,推动着社会生产力的发展,是全球经济增长最具潜力的领域之一。未来贸易方式因电子科技的发展而发生改变,电子商务代表着未来经济的发展方向,电子商务越来越渗入到现在经济活动的每一个细胞中,使得传统贸易市场向电子商务市场转变。改革开放以来,我国经济快速发展,经营方式也越来越多元化,与国外相比较,国内电子商务发展起步晚,但是其发展速度却很迅速。中国电子商务的发展,为国内贸易市场开拓了一条新的发展道路,电子商务市场在给社会经济带来便利的同时,也带来了很多问题。电子商务市场是新型市场,相关法律法规不健全,电子商务行政监督手段落后,使得电子商务发展过程中,出现很多违法犯罪问题。竞争秩序,竞争机制混乱,消费者权益得不到保护,都影响着电子商务市场的正常发展,危害电子商务市场的正常经营秩序。建立良好,有序的电子商务竞争秩序,营造良好的购物环境,完善电子商务相关法律法规的空缺,是政府相关部门必须解决的问题。如果让电子商务市场的发展在正确轨道上前行,指引和规范电子商务合理有序发展,政府相关部门必须担负起相关责任。作为政府实施经济监督的重要职能部门之一的工商行政管理部门,具有监管社会主义市场的责任和使命,要全面履行市场监督管理和行政执法职能,就必须对当前电子商务市场进行深刻的研究和讨论,监管电子商务市场的运行,是工商行政管理机关的责任与职责之一。 本文在分析目前我国电子商务发展现状,借鉴欧美国家和国际组织的法律法规和监管措施之上,并通过对国内电子商务市场的功能分析,从工商行政管理部门的职能出发,确定工商行政管理部门在电子商务市场的位置以及扮演的角色,分别从立法,市场准入,广告监督及消费者权利保护等方面阐述工商行政管理部门应改变传统的监管方式,以适应对电子商务市场的有效监管,维护电子商务市场的公平竞争秩序,创造良好的市场环境,促进其健康有序发展。希望通过本文的探讨,帮助工商管理部门找到自己的定位,改革创新出有效的服务措施和监管方式,更好的推荐电子商务的积极健康的发展。
[Abstract]:E-commerce, as a new type of market transaction mode, has been used more and more widely in our daily life. E-commerce has the characteristics of quickness and convenience, which reflects the development direction of the future trade mode. At the same time, it has been widely approved and recognized by the society. The e-commerce market is the fastest growing, the most potential field, the rapid development and application of e-commerce. Promoting the development of social productivity is one of the most potential areas of global economic growth. The future trade mode is changed by the development of electronic science and technology, e-commerce represents the future direction of economic development. E-commerce is increasingly infiltrating into every cell of economic activity, making the traditional trade market turn to e-commerce market. Since the reform and opening up, China's economy has developed rapidly, and the mode of operation has become more and more diversified. Compared with foreign countries, the development of domestic electronic commerce started late, but its development speed is very fast. The development of China's electronic commerce has opened up a new way for the domestic trade market. E-commerce market brings convenience to social economy, but also brings a lot of problems. E-commerce market is a new market, the relevant laws and regulations are not perfect, electronic commerce administrative supervision means lag behind. The process of e-commerce development, there are a lot of illegal and criminal issues. Competition order, competition mechanism chaos, consumer rights and interests can not be protected, all affect the normal development of e-commerce market. Endanger the normal business order of e-commerce market. Establish a good and orderly electronic commerce competition order, create a good shopping environment, improve the vacancy of e-commerce laws and regulations. If the development of e-commerce market is on the right track, guide and standardize the rational and orderly development of e-commerce. As one of the important functional departments of the government to implement economic supervision, the administrative department for industry and commerce has the responsibility and mission of supervising the socialist market. In order to fully perform the functions of market supervision, management and administrative law enforcement, it is necessary to conduct profound research and discussion on the current electronic commerce market and supervise the operation of the electronic commerce market. It is one of the responsibilities and responsibilities of the industrial and commercial administrative organs. This paper analyzes the current development of e-commerce in China, drawing lessons from the European and American countries and international organizations of laws and regulations and regulatory measures, and through the analysis of the functions of the domestic e-commerce market. Starting from the functions of the administrative department for industry and commerce, this paper determines the position and role of the administrative department of industry and commerce in the electronic commerce market, respectively from the perspective of legislation and market access. Advertising supervision and consumer rights protection and other aspects of the administrative departments for industry and commerce should change the traditional way of supervision in order to adapt to the effective supervision of the electronic commerce market and maintain the fair competition order of the electronic commerce market. To create a good market environment to promote its healthy and orderly development. Through this discussion, I hope to help the business administration to find its own position, reform and innovation of effective service measures and regulatory methods. Better recommend the positive and healthy development of e-commerce.
