我国跨境网购纠纷在线解决制度建构研究

【摘要】:互联网技术的革新使得跨境电子商务得到了大幅度的发展。其中,作为跨境电子商务的重要组成部分——跨境网购,凭借其自身的优势愈发成为网上购物一族的宠儿。根据中国电子商务研究中心发布的《2015年中国跨境网购报告》显示,2013年我国跨境网购总额达到2160亿,预计2018年将会突破一万亿;而2013年我国跨境网购总人数为1800万人次,预计2018年将会达到3600万人次。可见,我国作为世界跨境电子商务大国,国内海淘大军的实力不容小觑。然而,交易的兴起势必会附随大量纠纷的产生,特别是针对于突破国界的跨境网购,其不同于现实社会中的交易纠纷,而是还包含有虚拟性、真空性、涉外性等特征。当前,世界范围内针对此类纠纷主要是通过适用诉讼,调解、仲裁等解决手段加以处理。然而,在适用的过程中,这些传统型的纠纷解决措施的局限性与不适性逐渐突显出来,诸如维权成本高、耗费时间久,执行困难等问题。可以说,对于跨境网购纠纷的处理,传统的纠纷解决制度以及替代性解决制度在适用上均面临着“心有余而力不足”的困境。面临着当前网购纠纷普遍化和多元化这一客观现实,迫切需要在传统的法律救济体系框架之外寻求一个能够满足跨境电子商务特性的纠纷解决途径。而纠纷在线解决方式,其运用网络技术解决网络纠纷的方法不禁让人联想到对于跨境网购纠纷的处理亦可以通过将传统的纠纷解决方式与纠纷在线解决二者结合成一体进行探索。考察到我国目前的跨境网购纠纷的客观现状,加之出于对我国跨境电子商务发展前景的考虑,我国对于构建自己的跨境网购纠纷在线解决制度已经迫在眉睫。而这一切并不是纸上空谈,不切实际的想法。相反,不论是从我国已有的通信和互联网技术方面,建立我国纠纷在线解决制度的法制环境方面,还是纠纷在线解决的社会认可度方面,都已具备了良好的基础条件,加之我国一直以来不断探索的在线解决纠纷的实践经验,可以说建构我国的跨境网购纠纷在线解决制度十分具有可行性。目前,电子商务发达区域对于跨境网购纠纷的解决已经纷纷通过制定规则的形式予以确立,诸如美国《跨境电子商务消费者纠纷的电子解决草案(示范法/合作框架)》、欧盟《消费者ODR条列》、联合国《跨境电子商务交易网上争议解决:程序规则》。在对比分析借鉴这三个最新和最为完备的域外跨境网购纠纷在线解决制度相关规则的基础上,最终提出一套建构我国的跨境网购纠纷在线解决制度的具体措施,即构建中国跨境网购纠纷在线解决平台,并通过设置在线协商、在线调解和在线仲裁三大环节,辅以执行反馈制度、信用制度等对跨境网购纠纷予以解决。
[Abstract]:With the innovation of Internet technology, cross-border e-commerce has been greatly developed. Among them, as an important part of cross-border e-commerce, cross-border online shopping, With its own advantages, China is increasingly becoming a favorite of online shopping. According to the 2015 China Cross-border online purchase report released by the China E-Commerce Research Center, the total amount of cross-border online shopping in China reached 216 billion in 2013 and is expected to exceed 1 trillion in 2018. The total number of cross-border online purchases in China was 18 million in 2013, and it is expected to reach 36 million in 2018. The rise of transactions is bound to be accompanied by a large number of disputes, especially for cross-border online shopping that breaks through national boundaries, which is different from the transaction disputes in real society, but also contains the characteristics of fictitious, vacuum, and foreign affairs. At present, In the world, this kind of dispute is mainly dealt with through the application of litigation, mediation, arbitration and other means of settlement. However, in the process of application, the limitation and discomfort of these traditional dispute resolution measures are gradually highlighted. Such issues as high cost of safeguarding rights, time-consuming, difficult to implement, etc. It can be said that the settlement of cross-border online shopping disputes, Both the traditional dispute resolution system and the alternative resolution system are faced with the dilemma of "having more than their heart but not enough effort", and facing the objective reality of the generalization and diversification of online purchase disputes. There is an urgent need to find a way to resolve disputes outside the framework of traditional legal remedies that can meet the characteristics of cross-border e-commerce. The method of using network technology to solve network disputes can not help but remind people that the settlement of cross-border online shopping disputes can also be explored by combining traditional dispute resolution and online dispute resolution. To the current situation of cross-border online shopping disputes in China, In addition, considering the prospect of cross-border e-commerce development in China, it is urgent for China to build its own online resolution system for cross-border online shopping disputes. And all this is not an empty, unrealistic idea on paper. On the contrary, Both in terms of communication and Internet technology, the legal environment for the establishment of online dispute resolution system in China, and the social recognition of online dispute resolution, all of them have had good basic conditions. In addition, the practical experience of online dispute resolution that our country has been continuously exploring for a long time, it can be said that it is very feasible to construct an online settlement system for cross-border online shopping disputes in our country. At present, The settlement of cross-border online shopping disputes in developed regions of electronic commerce has been established one after another through the formulation of rules. For example, the United States, draft Electronic settlement of Consumer disputes in Cross-border Electronic Commerce (Model Law / Cooperation Framework), EU, Consumer ODR, United Nations, online dispute Resolution in Cross-border Electronic Commerce transactions: rules of procedure. On the basis of analyzing and drawing lessons from the three latest and most complete online settlement rules of cross-border cross-border online shopping disputes, Finally, this paper puts forward a set of concrete measures to construct the online resolution system of cross-border online shopping disputes in China, that is, to build an online platform for online resolution of cross-border online shopping disputes in China, and to set up three major links: online negotiation, online mediation and online arbitration. Supplementary to the implementation of feedback system, credit system and so on to cross-border online purchase disputes to be resolved.
