我国网络购物中消费者后悔权制度研究

【摘要】:随着互联网技术的迅速发展,网络购物也越来越频繁。作为当今社会非传统交易方式中最普遍的交易方式,网络购物方便了生活,但网络购物纠纷的数量也在不断上涨,消费者权益也面临更严峻的挑战。从发达国家和地区的法律规定以及国际条约来看,他们在很早之前就对直销领域、上门销售、远程交易、电子商务、邮购买卖等交易模式中的消费者赋予后悔权或者规定相应的冷却期,从而更好地保护了消费者的权益。我国新修订的《消费者权益保护法》第二十五条有关于“七天无理由退货”的规定实际上是在我国确立了消费者后悔权制度,但是法律条文仅做出了简单的规定,对于后悔权适用的范围、条件以及消费者行使后悔权的限制等方面的规定尚不完善,该制度的实施还应配以具体的实施细则,以及相应的监督措施。本文在明确后悔权概念与性质的前提下,通过分析我国关于消费者后悔权的立法现状,为完善我国消费者后悔权制度提供了思路上的借鉴,并结合现实消费案例揭示的问题,就我国消费者后悔权实施细则、防止权力滥用的措施以及实施的保障机制等方面提出了完善我国消费者后悔权制度的建议。
[Abstract]:With the rapid development of Internet technology, online shopping is becoming more and more frequent.As the most common transaction mode in today's society, online shopping facilitates life, but the number of online shopping disputes is also rising, consumer rights and interests are also facing more severe challenges.According to the laws and regulations of developed countries and regions as well as international treaties, they have long been involved in direct sales, home sales, remote trading, electronic commerce,In the mode of mail-order trading, consumers have the right of regret or the corresponding cooling-off period, thus protecting the rights and interests of consumers better.Article 25 of the newly revised Law on Protection of Consumer Rights and interests has the provision of "seven days without reason to return goods". In fact, the system of consumers' right of regret has been established in our country, but the provisions of the law have only made a simple provision.The scope and conditions of the application of the right of regret, as well as the restriction of the consumer's exercise of the right of regret, are not perfect, and the implementation of the system should be accompanied by specific rules and regulations, as well as the corresponding supervision measures.On the premise of defining the concept and nature of the right of regret, this paper analyzes the current situation of legislation on the right of consumer regret in our country, which provides a reference for perfecting the system of the right of regret of consumers in our country, and combines with the problems revealed by the real consumption cases.In this paper, the author puts forward some suggestions on how to perfect the system of consumer's right of regret in our country from the aspects of implementing detailed rules of consumer's right of regret, measures to prevent abuse of power and safeguard mechanism.
