电子商务环境下消费者权益的法律保护研究

【摘要】:随着经济水平的不断发展和生活水平的不断提高,电子商务凭借其时空不受限、商品展示全面、评价公开性强和交易快捷实惠的特点为越来越多消费者所选择。从2000年至今,我国的电子商务,尤其是C2C模式取得了长足发展,在百姓生活中所占的地位逐步提高,也得到了专家、政府的极大关注。然而,在电子商务市场规模蓬勃发展,参与人数急剧增加的同时,现行法律漏洞的客观因素和经营者主观因素的综合作用导致众多消费者遭到侵害,却难以得到及时有效的保护。如何保护消费者权益的问题也自然而然地成为我国电子商务的健康发展面临的巨大挑战。本文从理论分析入手,剖析电子商务环境下消费者权益保护的特点。结合域外先进法律制度之规定,与我国现行法律进行比较,寻找我国相关规定存在的问题,并提出完善电子商务环境下我国消费者权益法律保护的具体措施,以期促进我国电子商务立法,促进电子商务发展。本文正文分为四部分。 第一部分讨论了电子商务环境下的消费者权益保护的特点,主要总结出了网络交易平台对消费者要承担保护责任、消费者权益内容有所扩张以及传统救济途径维权存在困境等三个要点,为后文的分析打下基础。 在第二部分中分别介绍了美国模式、日本模式和欧盟模式,抓出三种模式的特点和优势,并着重列举与电子商务中的消费者权益保护最为紧密的规定。随后总结出三种模式加强保护力度、注重法律协调性、尊重当事人意思自治的共同特点,进而得出发展我国相关法律制度的启示。 本文在第三部分对电子商务环境下我国消费者权益保护的现状进行了研究。该部分首先介绍电子商务消费流程,分析其中的潜在风险并列举现行法律中存在的解决方案,找出目前我国在消费者保护方面存在的问题,即侵害消费者权益行为的客观成因。此外,本文还通过成本收益分析法从经营者的违法成本、经营成本和收入之比较的角度,分析侵权行为主观成因。 在完成上文分析的基础上,本文从实体方面提出解决目前问题应该采取的立法措施,如扩大消费者权益范围、严格交易平台责任等;从程序方面提出了保障法律有效运行的具体制度,如建立在线纠纷解决机制、设立小额消费纠纷法庭和仲裁制度、调整现有消费者权益保护组织等方案。最后,文章对前文分析进行总结,就如何建立具有中国特色的电子商务环境下的消费者权益保护制度提出综合性结论,力图为电子商务环境下我国消费者权益的法律保护做出贡献。
[Abstract]:With the development of economic level and the improvement of living standard, more and more consumers choose electronic commerce because of its unlimited time and space, comprehensive display of goods, strong evaluation of openness and quick and affordable transactions. Since 2000, China's e-commerce, especially the C2C model, has made great progress, and the status in the life of the people has been gradually improved, which has also been paid great attention by experts and the government. However, while the scale of the e-commerce market is booming and the number of participants is increasing sharply, the combined effect of the objective factors of the current legal loopholes and the subjective factors of the operators has led to the infringement of many consumers. But it is difficult to get timely and effective protection. How to protect the rights and interests of consumers has naturally become a great challenge to the healthy development of e-commerce in China. This paper analyzes the characteristics of the protection of consumers' rights and interests under the environment of e-commerce. In combination with the provisions of the foreign advanced legal system, this paper makes a comparison with the current laws of our country, finds out the problems existing in the relevant regulations of our country, and puts forward some concrete measures to improve the legal protection of the rights and interests of consumers in the environment of electronic commerce. In order to promote the legislation of e-commerce in China, promote the development of e-commerce. The text of this paper is divided into four parts. The first part discusses the characteristics of the protection of consumers' rights and interests under the environment of electronic commerce, and summarizes that the network trading platform should bear the responsibility of protecting consumers. The expansion of consumer rights and interests and the dilemmas of traditional remedies lay the foundation for the later analysis. In the second part, the American model, the Japanese model and the European model are introduced respectively. The characteristics and advantages of the three models are discussed, and the most closely related provisions to the protection of consumers' rights and interests in electronic commerce are emphatically listed. Then it summarizes the three models to strengthen the protection, pay attention to the coordination of the law, respect the common characteristics of party autonomy, and then draw the enlightenment of the development of the relevant legal system in China. In the third part of this paper, the current situation of consumer protection in e-commerce environment is studied. This part first introduces the process of e-commerce consumption, analyzes the potential risks and enumerates the existing solutions in the current law, and finds out the existing problems in consumer protection in our country, that is, the objective cause of the infringement of consumer rights and interests. In addition, this paper also analyzes the subjective causes of tort from the perspective of the comparison of illegal cost, operating cost and income of the operator through cost-benefit analysis. On the basis of the above analysis, this paper puts forward some legislative measures to solve the current problems, such as expanding the scope of consumers' rights and interests, strictly enforcing the liability of trading platform, and so on. From the aspect of procedure, this paper puts forward specific systems to ensure the effective operation of law, such as establishing online dispute resolution mechanism, setting up small consumption dispute court and arbitration system, adjusting existing consumer rights and interests protection organizations and so on. Finally, the article summarizes the previous analysis, and puts forward a comprehensive conclusion on how to establish the consumer rights and interests protection system under the electronic commerce environment with Chinese characteristics. Try to make a contribution to the legal protection of consumer rights and interests under the environment of e-commerce.
