海外代购中商标平行进口问题的困境与对策

【摘要】：海外代购符合平行进口的标准与特征,且大多涉及商标平行进口问题。但是商标平行进口不仅仅是一个知识产权范畴中的理论争议问题,其本身亦是一个利弊兼具的国际贸易问题,其自身困境与海外代购乱象的叠加效应致使海外代购中的商标平行进口问题更为复杂。究其根源,实际体现了保护知识产权和促进自由贸易之间的博弈,从我国国情及未来发展趋向来看,在《商标法》中明确商标平行进口的限定标准,并在政策上引导、制度上规范将更符合我国的长远利益。
[Abstract]:Overseas purchasing conforms to the standards and characteristics of parallel imports, and most of them involve parallel import of trademarks. But the parallel import of trademark is not only a theoretical issue in the field of intellectual property, which itself is a problem of international trade has its own advantages and disadvantages, the superimposed effect of dilemma and overseas purchasing chaos resulting in the issue of parallel import of trademark in overseas purchasing more complex. The reason, actually reflects the protection of intellectual property rights and promote free trade between the game, from China's national conditions and the development trend of the future, defining clear standards of trademark parallel imports in the "trademark law", and in the policy guidance, the system specification will be more in line with China's long-term interests.
