互联网金融理财产品的本质、边界与监管

【摘要】：互联网金融的供给端互联网理财产品市场乱象丛生。醒目的年化收益率与含糊不清的产品本质表达,加重了投资者投机心理,延续了传统理财市场刚性兑付、政府隐性担保的顽疾,为2015年夏的股市动荡埋下祸根,究其根源,是金融体制的缺陷。监管应分两步走:现阶段,厘清互联网理财产品本质与理财平台功能,对接、归位并完善传统理财产品的监管制度。下阶段,修改法律制度,为"证券""信托""集合投资计划"正名,并将同一功能理财产品的规则进行整合,向功能监管转变。
[Abstract]:The supply side of Internet finance, Internet financial products market chaos. The striking annualized yield and ambiguous product essence have aggravated investors' speculative psychology, continued the rigid payment of traditional financial markets, and the persistent disease of government implicit guarantees, laying the root of the stock market turmoil in the summer of 2015 and investigating its root causes. It is a flaw in the financial system. Supervision should be divided into two steps: at this stage, clarify the nature of Internet financial products and the function of financial platform, docking, return and improve the traditional financial products regulatory system. In the next stage, we should revise the legal system, correct the name of "securities", "trust" and "collective investment plan", and integrate the rules of the same functional financial management product into functional supervision.
