知识产权互联网质押融资的风险及其法律规制

【摘要】：知识产权互联网质押融资方式在有效解决知识产权产业化融资难题、促进创新创业的同时,也因质押资产的知识产权化及融资方式的互联网化而存在诸多有别于传统银行融资方式的风险。通过构建多元化的风险分散机制、提高知识产权质押资产变现及时性、探索知识产权互联网质押融资保险制度、设置投资者实体性准入条件及融资平台教育投资者的制度、以投资者判断力为导向的信息披露制度及规范融资平台融资业务流程的制度、第三方参与及各主体间的监督制约制度,完善全社会征信体系的制度、能够有效规制知识产权互联网质押融资风险。
[Abstract]:The Internet pledge financing method of intellectual property not only effectively solves the financing problem of intellectual property industrialization, but also promotes innovation and entrepreneurship. Because of the intellectual property of pledge assets and the internet of financing methods, there are many risks which are different from the traditional bank financing methods. By constructing a diversified risk dispersion mechanism, improving the timeliness of the realization of intellectual property rights pledge assets, exploring the intellectual property Internet pledge financing insurance system, setting up investor entity access conditions and the system of financing platform to educate investors. The information disclosure system based on investors' judgment and the system of standardizing the financing business process of financing platform, the system of third party participation and supervision and restriction among various subjects, and the system of perfecting the whole society credit system, Can effectively regulate intellectual property rights Internet pledge financing risk.
