我国互联网金融风险化解与监管体系创新研究

【摘要】：当前,伴随着我国互联网金融的高速发展,规制缺失带来的潜在互联网金融风险日益突出,在鼓励金融创新的基础上迫切需要提出一套适合我国国情的互联网金融监管思路。本文在深入分析我国互联网金融亟待化解的三大突出风险的基础上,重点研究了发达国家在鼓励和开放的前提下,通过立法和差异化监管规范互联网金融发展的政策举措,并从处理好"必须"监管与"必要"监管关系,实施功能监管与机构监管相结合监管方式,构建登记注册、信息披露、资金托管三大监管底线,运用好互联网金融科技属性四个方面,提出我国金融监管体系只有通过不断完善和创新才能有效化解互联网金融风险的监管对策。
[Abstract]:At present, with the rapid development of Internet finance in China, the potential Internet financial risks brought by the lack of regulation are becoming increasingly prominent. On the basis of encouraging financial innovation, it is urgent to put forward a set of ideas of Internet financial supervision suitable for the national conditions of our country. On the basis of in-depth analysis of the three outstanding risks that need to be resolved in China's Internet finance, this paper focuses on the policy measures of regulating the development of Internet finance through legislation and differentiated supervision under the premise of encouraging and opening up in developed countries. And from dealing with the relationship between "must" supervision and "necessary" supervision, implementing the combination of functional supervision and institutional supervision, and constructing the bottom line of registration, information disclosure and fund custody, This paper makes good use of the scientific and technological attributes of Internet finance, and puts forward the regulatory countermeasures that can effectively resolve the financial risks of Internet only through continuous improvement and innovation in the financial supervision system of our country.
