山东省非公企业工会维护职工权益问题研究

【摘要】:当前,山东省经济社会正处于供给侧结构性改革的关键时期,非公企业发展迅速,根据2015年的统计数据,民营经济在山东省经济总量的比重已超过国有企业,达到了 60%,全省95%以上的中小企业是民营企业,非公企业职工已达1300万,占全省职工的80%,工会会员超过1200万。非公企业职工队伍是否稳定,直接影响山东省能否平稳度过社会转型期,以及能否按时完成"两个一百年"的任务目标。在过去相当长的时间里,中国各方对于建立完善维护职工权益的体制机制重视程度不足,加上日渐加剧的"强资本弱劳工"的劳动关系格局,非公企业职工的各项合法权益常常得不到保障。代表和维护职工利益的工会组织,就需要高调的站出来,承担起法律赋予的职责-维护职工群众的合法利益,主动、依法、科学维权。在做好两个维护相统一,构建和谐劳动关系,促进社会和谐稳定上,非公企业工会究竟要怎样发挥和发挥什么样的作用,·面对非公企业转型升级、职工队伍组成日益多样化、劳动关系复杂多变的新情况、新问题,如何落实非公企业工会维权职责,怎样解决非公企业工会作用发挥不明显的问题,是中国工会组织当前亟待研究和实践的重要课题。要落实非公企业维权职责,就要从改进非公企业工会工作模式,创新非公企业工会工作思路上做出突破,才能真正地发挥出非公企业工会的维权职能,更好的团结和凝聚广大职工群众,坚定不移地执行党的决策,努力实现党制定的各项目标。因此,针对非公企业工会维权问题的研究,对于实现"两个一百年"目标和开创经济文化强省建设新局面均有重要的理论意义和现实意义。本文由五个部分组成,第一部分对选题的研究背景、意义,研究方法进行了介绍,归纳概括了当前国内外研究现状;第二部分就工会维护非公企业职工权益的相关概念及非公企业工会维权的特点进行了阐释和界定;第三部分通过分析山东省内非国有控股股份制、私营和外资等19家非公企业和部分职工代表的调查问卷,初步得出工会在维护非公企业职工权益上的有关数据,以及非公企业职工对工会的认知状况;第四部分对山东省非公企业工会维权存在的问题及产生的原因进行分析;第五部分从在社会层面创造良好外部环境,加强非公企业工会组织规范化建设,加强维权机制建设,加强对非公企业工会的组织领导等四个方面提出了落实山东省非公企业工会维权职能的对策和建议。
[Abstract]:At present, Shandong's economy and society are in the crucial period of supply-side structural reform. Non-public enterprises are developing rapidly. According to the statistics of 2015, the proportion of private economy in the total economic volume of Shandong Province has surpassed that of state-owned enterprises, reaching 60%. More than 95% of the province's small and medium-sized enterprises are private enterprises, non-public enterprise workers have reached 13 million, accounting for 80% of the province's workers, workers more than 12 million members. Whether the staff and workers of non-public enterprises is stable or not has a direct impact on whether Shandong Province can smoothly pass the social transition period and whether it can finish the task goal of "two hundred years" on time. For quite a long time in the past, all parties in China have paid insufficient attention to the establishment of a sound institutional mechanism for safeguarding the rights and interests of workers, coupled with the growing pattern of labor relations of "strong capital and weak labor." The legitimate rights and interests of employees in non-public enterprises are often not protected. Trade union organizations that represent and safeguard the interests of workers and staff need to stand out in a high profile and assume the responsibilities conferred by law-to safeguard the legitimate interests of the masses of workers, to take the initiative, to safeguard their rights in accordance with the law, and to safeguard their scientific rights. In order to unify the two maintenance, construct harmonious labor relations and promote social harmony and stability, how should the trade unions of non-public enterprises bring into play and play what role, facing the transformation and upgrading of non-public enterprises, the composition of the staff and workers is becoming more and more diverse. The complex and changeable new situation of labor relations, new problems, how to carry out the duty of safeguarding the rights of trade unions in non-public enterprises, and how to solve the problem that the role of trade unions in non-public enterprises is not obvious is an important subject for the research and practice of the trade union organizations in China at present. In order to carry out the duty of safeguarding the rights of non-public enterprises, we must make a breakthrough in improving the mode of trade union work in non-public enterprises and in innovating the ideas of trade union work in non-public enterprises, in order to give full play to the function of safeguarding the rights of trade unions in non-public enterprises. Better unite and agglomerate the masses of workers and staff, unswervingly carry out the party's decision-making, and strive to achieve the goals set by the party. Therefore, it is of great theoretical and practical significance to study the rights of trade unions in non-public enterprises in order to realize the goal of "two hundred years" and to create a new situation for the construction of a strong province with strong economy and culture. This paper consists of five parts. The first part introduces the research background, significance and research methods of the topic, and summarizes the current research situation at home and abroad. The second part explains and defines the related concepts of trade union safeguarding the rights and interests of workers in non-public enterprises and the characteristics of trade union rights protection in non-public enterprises. In the third part, by analyzing the questionnaire of 19 non-public enterprises and some workers' representatives in Shandong province, including non-state-owned holding stock system, private enterprise and foreign capital, the author preliminarily obtains the relevant data of labor union in safeguarding the rights and interests of non-public enterprises. And the cognition of the non-public enterprise workers to the trade union; The fourth part analyzes the existing problems and causes of trade union rights protection in non-public enterprises in Shandong Province. The fifth part from the social level to create a good external environment, strengthen the non-public enterprise trade union organization standardization construction, strengthen the rights protection mechanism construction, This paper puts forward countermeasures and suggestions on how to strengthen the organization and leadership of trade unions in non-public enterprises in Shandong Province.
