我国农村土地流转模式中农民权益保障比较研究

【摘要】：自1984年我国在政策上允许实行农地流转后,我国逐渐出现了不同模式的农地流转,各种模式在农民权益均存在不同程度的流失。重视农民权益,减少农地流转中农民权益流失,是进一步深化改革农地制度和完善农村土地流转市场的必然选择,也是农民的基本要求。本文在对农民权益进行界定的基础上,从农民权益保障的角度出发,对我国农地流转制度改革历程进行阶段性讨论,并认为农民权益是我国农地流转制度变迁的核心。本文重点分析了我国农地流转模式中影响农民权益的主要因素,并以这些影响因素为出发点,对我国农地流转模式进行比较分析,进而对我国不同的农地流转模式的农民权益进行比较分析,最后提出明晰农地产权的法律界定、建立农地流转中介组织、建立公平合理的农地流转价格评估体系、推广种植经济作物等政策手段来加强农民权益保障。
[Abstract]:Since 1984, China has allowed the transfer of agricultural land in the policy, China has gradually emerged different patterns of agricultural land transfer, various models in the farmers' rights and interests of different degrees of loss, attach importance to the rights and interests of farmers. To reduce the loss of farmers' rights and interests in the agricultural land transfer is the inevitable choice to further reform the farmland system and perfect the rural land transfer market, and is also the basic requirement of the farmers. This paper defines the farmers' rights and interests. From the perspective of the protection of farmers' rights and interests, this paper discusses the reform process of farmland circulation system in China. This paper focuses on the analysis of the main factors affecting the farmers' rights and interests in the mode of agricultural land transfer in China, and takes these factors as the starting point. This paper makes a comparative analysis on the mode of agricultural land transfer in China, and then makes a comparative analysis of the farmers' rights and interests of different agricultural land transfer modes in our country. Finally, it puts forward the legal definition of clarifying the property rights of agricultural land, and establishes the intermediary organization for the transfer of agricultural land. Establishing a fair and reasonable price evaluation system of agricultural land circulation and popularizing the policy means such as planting cash crops to strengthen the protection of farmers' rights and interests.
