农村征地冲突的发生机制及化解途径研究

【摘要】：在中国社会高速发展和城市化快速推进的时期，我国农地非农化征用加速，，农民土地权益严重受损，由此引发的农村征地冲突已逐渐成为影响我国农村社会稳定和经济发展的重要问题。但由于我国农村土地问题的相关法律法规不健全、产权不明晰、征地制度缺陷等原因，致使农村征地冲突的化解机制严重匮乏，征地冲突治理工作效果低下。随着我国今后将继续推进新型城镇化战略实施，农村征地矛盾冲突必将愈演愈烈。因此，在此背景下，本文在借鉴国外征地冲突研究优秀成果以及结合我国特殊国情的基础上，试图寻找征地冲突的内在发生机理，并据此提出相应的化解途径。本文通过对国内外相关文献进行梳理，并结合我国城市化发展的现状以及我国农村征地冲突研究的第一手资料，深入剖析征地冲突的根源与内在发生机理，以期对农村土地征收冲突的预防及化解提供参考借鉴。本文由五部分构成，第一部分引言对农村征地冲突的研究背景及选题意义做了阐述，确定本文的研究方向，并详细地介绍了国内外对土地征收的研究状况，从而拟定本文研究的主要方法及基本框架。第二部分对农村征地冲突的相关概念进行界定，揭示了新型城镇化时期冲突的基本特征及类型，并在此基础上，为农村征地冲突的研究提供了相关理论依据。第三部分对农村征地冲突的利益相关者进行了界定和相互间博弈关系分析，确定了五个主要的农村征地冲突参与主体，并对他们之间的博弈成本及博弈损益做了详细的阐述，然后运用完全信息静态博弈模型对冲突中主要的利益相关者进行博弈分析。第四部分通过利用社会冲突和集体行动等理论进一步深入剖析引发征地冲突的根源与内在发生机理，概括出当前社会发展背景下，征地冲突的内在发生机制。第五部分本文最后针对农村征地冲突发生的内在机制，探索化解农村征地冲突的方法和手段，提出了规避征地冲突的对策建议：规范征地制度，合理补偿安置；利益协调整合，拓展政治参与；健全社保制度，增强可行能力；完善公共服务，改进危机管理。希冀能对化解农村征地冲突引发的群体性事件有一定的借鉴作用，并希望本论文能够丰富和完善未来对有关农村征地冲突的理论研究。
[Abstract]:During the period of rapid social development and rapid urbanization in China, the expropriation of agricultural land was accelerated, and the farmers' land rights and interests were seriously damaged. The conflict of rural land expropriation has gradually become an important problem affecting the social stability and economic development of rural areas in China. However, due to the unsound laws and regulations related to rural land issues, the lack of clarity of property rights and the defects of land expropriation system, etc. As a result, the resolving mechanism of rural land expropriation conflict is seriously lacking, and the effect of land expropriation conflict management is low. As our country will continue to promote the implementation of the new urbanization strategy in the future, the contradictions and conflicts in rural land requisition will surely become more and more serious. Therefore, in this context, This paper tries to find out the internal mechanism of the conflict of land expropriation on the basis of drawing lessons from the outstanding achievements in the study of land expropriation conflict abroad and combining with the special national conditions of our country, and puts forward corresponding ways to resolve the conflict. By combing the relevant literature at home and abroad, combining with the present situation of urbanization development in China and the first-hand data of the study on the conflict of land expropriation in China, this paper deeply analyzes the root and internal mechanism of the conflict of land expropriation. This paper is composed of five parts. The first part introduces the background and significance of the research on the conflict of rural land expropriation, and determines the research direction of this paper. It also introduces the research status of land expropriation at home and abroad in detail, and draws up the main methods and basic framework of this paper. The second part defines the related concepts of the conflict of land expropriation in rural areas. This paper reveals the basic characteristics and types of conflicts in the period of new urbanization, and on this basis, The third part defines the stakeholders of the conflict of rural land expropriation and analyzes the game relationship between them, and determines five main participants in the conflict of rural land expropriation. And the game cost and game profit and loss between them are described in detail. Then we use the static game model of complete information to analyze the main stakeholders in the conflict. Part 4th further analyzes the root cause and internal mechanism of land expropriation conflict by using the theories of social conflict and collective action. This paper summarizes the internal mechanism of the conflict of land expropriation under the background of current social development. 5th part of this paper aims at the internal mechanism of the conflict of land expropriation in rural areas, and explores the methods and means to resolve the conflict of land expropriation in rural areas. The countermeasures and suggestions of avoiding the conflict of land expropriation are put forward: standardizing the land expropriation system, reasonable compensation and placement, coordinating and integrating interests, expanding political participation, perfecting social security system, enhancing feasible ability, perfecting public service, It is hoped that it can be used for reference to resolve the group events caused by the land expropriation conflict in rural areas, and hope that this paper can enrich and perfect the theoretical research on the conflict of land expropriation in the future.
