湖南省农产品地理标志保护的现状及对策研究

【摘要】：随着世界经济的发展,世界各国经济联系日益密切,市场竞争日益激烈,为了提高本国农产品在世界市场的竞争力,世界各国相继加强了对本国农产品地理标志的保护,我国也不例外。随着改革开放的不断深入和加入世贸组织的迫切要求,同时也为了提高我国农产品质量水平使之与世界经济接轨,于上世纪九十年代开始着手研究农产品地理标志保护制度,但相比于欧美等发达国家长达一个多世纪的农产品地理标志保护制度发展而言,我国目前还处于农产品地理标志保护的初级阶段,各方面的制度都不完善,特别是立法保护、职能机构的设置和保护意识等方面存在较大的问题。湖南省作为我国的农业大省,有“鱼米之乡”的美誉,拥有大量具有地方特色的名优农产品资源,为湖南省农产品地理标志保护奠定了坚实的基础。然而由于湖南省农产品地理标志保护起步晚,思想不够重视,加之国家层面在立法、职能机构设置等方面的不规范甚至冲突,对湖南省农产品地理标志的保护产生了一定的消极影响。本文旨在探索湖南省农产品地理标志保护在我国现有的保护体制下存在哪些问题,并针对这些问题提出相应的对策措施来加强湖南省农产品地理标志的保护,这是本文的落脚点。笔者将通过文献分析法从地理标志的概念入手,分析农产品地理标志的特征、保护模式及保护意义。运用数量研究法、比较分析法、个案研究法等研究方法,通过对湖南省农产品地理标志登记注册保护的现状进行调查分析,并以地理标志农产品湘莲的保护为例,分析湘莲的登记注册为地理标志农产品前后的保护情况及存在的问题,以小见大,分析出湖南省在农产品地理标志保护过程中存在的问题。通过对这些问题的分析,提出从：对湖南省名优农产品进行调查摸底,积极开展农产品地理标志的登记注册工作；重视农产品地理标志登记注册后的使用；梳理湖南省农产品地理标志保护的三大部门权限,加强扶持力度；提高农产品地理标志保护意识；职能部门加强监管执法,实施农产品地理标志品牌战略；积极探索农产品地理标志的国际注册保护等几个方面来加强湖南省农产品地理标志的保护,对湖南省农业现代化进程,发展农村经济,增加农民收入等方面有重要意义。
[Abstract]:With the development of the world economy, the world economy is getting closer and closer, and the market competition is becoming more and more intense. In order to improve the competitiveness of their agricultural products in the world market, the countries in the world have strengthened the protection of their own agricultural products' geographical indications one after another. China is no exception. With the deepening of reform and opening up and the urgent requirements of China's accession to the World Trade Organization, at the same time, in order to improve the quality of our agricultural products and bring them into line with the world economy, In -10s, we began to study the protection system of agricultural products geographical indications, but compared with the developed countries such as Europe and the United States for more than a century of agricultural product geographical indications protection system development, At present, our country is still in the primary stage of protecting the geographical indications of agricultural products, and all aspects of the system are not perfect, especially in the aspects of legislative protection, the setting up of functional institutions and the consciousness of protection, etc. Hunan Province is a big agricultural province in our country. It has the reputation of "land of fish and rice" and has a large number of famous and excellent agricultural products resources with local characteristics, which has laid a solid foundation for the protection of geographical indications of agricultural products in Hunan Province. However, the protection of geographical indications of agricultural products in Hunan Province started late. Lack of attention to ideas, coupled with irregularities or even conflicts at the national level in the areas of legislation, functional establishment, etc. The purpose of this paper is to explore the problems of the protection of agricultural products geographical indications in Hunan Province under the existing protection system of our country. To solve these problems, the author puts forward corresponding countermeasures to strengthen the protection of the geographical indications of agricultural products in Hunan Province, which is the foothold of this paper. The author will analyze the characteristics of geographical indications of agricultural products from the concept of geographical indications through literature analysis. The method of quantitative research, comparative analysis, case study and so on are used to investigate and analyze the present situation of the registration and protection of agricultural products geographical indications in Hunan Province, through the investigation and analysis of the status quo of the registration and protection of geographical indications of agricultural products in Hunan Province. Taking the protection of the geographical indication agricultural product Xianglian as an example, this paper analyzes the protection situation and existing problems before and after Xianglian's registration as a geographical indication agricultural product. Through a small part, we can see the whole. This paper analyzes the problems existing in the process of protecting the geographical indications of agricultural products in Hunan Province. Through the analysis of these problems, it puts forward the following points: investigating and mapping the famous and excellent agricultural products in Hunan Province, and actively carrying out the registration work of the geographical indications of agricultural products; Pay attention to the use after the registration of agricultural products geographical indications; comb the rights of the three departments of agricultural products geographical indication protection in Hunan Province, strengthen the support; improve the awareness of the protection of geographical indications of agricultural products; strengthen the supervision and enforcement of the functional departments, To implement the brand strategy of geographical indications of agricultural products, to actively explore the international registration and protection of geographical indications of agricultural products, to strengthen the protection of geographical indications of agricultural products in Hunan Province, to develop the rural economy in the process of agricultural modernization in Hunan Province, Increase farmer income wait for respect to have important meaning.
