农村集体产权改革与农村社区腐败治理机制建构

【摘要】：农村集体产权改革的根本目的是保护农民集体权益,赋予农民更多财产性权利。近年来农村社区腐败不断侵蚀农民集体权益,与产权改革的目的呈现冲突。农村社区腐败治理问题需要放置于农村集体产权的改革与变迁中进行理解,特别是从基础性的产权治理入手来进行探究。当前,最为典型的表现就是,农村集体产权制度因集体产权归属不清、责权不明和保护不严等,使得农村社区治理逐步陷入缺乏合理有效产权支撑的困境,突出表现为社区居民与集体经济组织成员、社区"两委"与集体经济组织、社区利益分配与集体经济主体缺位之间的矛盾。下一步,伴随全国农村社区建设工作的积极推进,农民财产权的保护成为农村社区矛盾解决的重点,农村社区腐败治理的关键,就是要确保农民集体有效行使集体土地所有权,重点从明晰产权主体、实施政经分离、完善赋权增能等三个方面着手,通过采取强化农村集体经济组织监督机制、规范农村集体资产管理运行机制、创新农村集体组织成员参与机制等,有效建构起预防和治理农村社区腐败的长效机制。
[Abstract]:The fundamental purpose of the reform of rural collective property rights is to protect the collective rights and interests of farmers and to endow farmers with more property rights. In recent years, corruption in rural communities has been eroding farmers' collective rights and interests, which conflicts with the aim of property right reform. The problem of governance of corruption in rural communities needs to be understood in the reform and changes of rural collective property rights, especially from the basic governance of property rights. At present, the most typical manifestation of the rural collective property right system is that the ownership of the collective property right is unclear, the responsibility and rights are not clear and the protection is not strict, which makes the rural community governance gradually fall into the predicament of lacking the reasonable and effective property right support. The contradiction between community residents and members of collective economic organizations, community "two committees" and collective economic organizations, the distribution of community benefits and the absence of the main body of collective economy are highlighted. In the next step, along with the positive promotion of the construction of rural communities throughout the country, the protection of farmers' property rights has become the focus of resolving the contradictions in rural communities. The key to the governance of corruption in rural communities is to ensure the effective exercise of collective land ownership by farmers. It focuses on three aspects: clarifying the main body of property right, implementing the separation of politics and economy, perfecting the empowerment and increasing energy, and standardizing the operation mechanism of rural collective assets management by strengthening the supervision mechanism of rural collective economic organizations and standardizing the operation mechanism of rural collective assets management. Innovating the participation mechanism of the members of rural collective organizations and effectively constructing a long-term mechanism for preventing and controlling corruption in rural communities.
