进城落户农民“三权”问题研究

【摘要】:随着当代中国城市化进程的不断加快,进城落户农民数量不断增加,在人口流向城市的同时,进城落户农民在农村的产权却没有与他们一起流向城市。本文在调查研究基础上提出,维护进城落户农民的土地承包权、宅基地使用权和集体收益分配权,前提是给他们赋权;应分置农民的经济权益、政治权益和社会权益,创新农村集体所有制的实现途径;通过农村产权量化,扩展农村产权的交易边界,发挥市场在资源配置中的决定性作用;支持引导进城落户农民依法有偿转让农村权益,进而提高农民的财产权益,提升城市化质量。
[Abstract]:With the accelerating process of urbanization in contemporary China, the number of peasants living in cities is increasing. While the population flows to cities, the property rights of peasants in rural areas do not flow to cities with them. On the basis of investigation and research, this paper puts forward that the premise of maintaining the land contract right, the right to use the homestead and the right to distribute the collective income of the peasants living in cities is to empower them, to divide the peasants' economic, political and social rights and interests. Innovating the ways to realize collective ownership in rural areas, extending the transaction boundary of rural property rights through quantification of rural property rights, giving play to the decisive role of the market in the allocation of resources, and supporting the guidance to peasants who have settled in cities to transfer rural rights and interests with compensation according to law, Then improve the property rights and interests of farmers, improve the quality of urbanization.
