农村宅基地上房屋征收补偿研究

【摘要】：我国的土地所有权制度是社会主义公有制,即土地是属于国家所有或集体所有。由于国家建设或其他公共利益的需要,越来越多的集体土地被征收为国有土地,尤其是属于集体建设用地的农村宅基地及其上房屋的征收补偿与村民的居住情况和财产权利息息相关。因此,为了规范农村宅基地上房屋的征收补偿,各地颁布了与农村宅基地上房屋征收补偿相关的地方性法规,尽管有地方立法对农村宅基地上房屋征收补偿进行规制,但在实践中,我国的农村宅基地上房屋征收补偿还存在很多问题,发展较为混乱,尤其是对补偿范围、补偿标准、补偿方式、补偿程序以及补偿争议救济的缺位,目前最缺少的是一部具有全国规范效力的农村宅基地上房屋征收补偿立法。本文拟从行政法的视角研究农村宅基地上房屋征收补偿,全文共分四个部分,第一部分从农村宅基地上房屋征收补偿的基础理论入手,对农村宅基地和农村宅基地上房屋征收补偿的概念、特征进行阐述,指出其行政补偿的性质,并将其与国有土地上房屋征收补偿制度相比较,得出二者的不同之处；第二部分通过梳理已经颁布的各省市的相关立法,明确目前关于农村宅基地上房屋征收补偿已经建立的各种法律制度,指出我国目前农村宅基地上房屋征收补偿立法己经取得的成效和存在的问题；第三部分对德国、法国、英国和美国的财产征收补偿立法作了简要的介绍,总结出其在财产征收补偿立法上的特点,以及对我国农村宅基地上房屋征收补偿立法的启示；第四部分,针对我国目前农村宅基地上房屋征收补偿立法存在的问题,给出完善建议。
[Abstract]:China's land ownership system is socialist public ownership, that is, land is owned by the state or collective ownership. Because of the need of national construction or other public interests, more and more collective land has been expropriated into state-owned land. Especially, the expropriation and compensation of the rural residential land and its upper houses are closely related to the villagers' living conditions and property rights. Therefore, in order to standardize the collection and compensation of houses on the rural homestead, local laws and regulations have been promulgated in various places, although there are local legislation to regulate the expropriation and compensation of the houses on the rural homestead. However, in practice, there are still many problems in the expropriation and compensation of houses on the rural homestead in our country, and the development is more chaotic, especially for the absence of compensation scope, compensation standard, compensation method, compensation procedure and compensation dispute relief. At present, what is most lacking is the legislation of expropriation and compensation of houses on rural homestead, which has the national standard effect. This paper intends to study the compensation of house expropriation on rural homestead from the perspective of administrative law. The paper is divided into four parts. The first part begins with the basic theory of the expropriation and compensation of houses on rural homestead. This paper expounds the concept and characteristics of the expropriation and compensation of houses on the rural homestead and the rural homestead, points out the nature of the administrative compensation, and compares it with the system of expropriation and compensation of the houses on the state-owned land, and draws the difference between the two. In the second part, by combing the relevant legislation of the provinces and cities that have been promulgated, the author clarifies the various legal systems that have been established for the collection and compensation of houses on the rural homestead at present. The paper points out the achievements and problems existing in the legislation on the expropriation and compensation of houses on the rural homestead in China. The third part briefly introduces the legislation of property expropriation and compensation in Germany, France, Britain and the United States. It summarizes its characteristics in the legislation of property expropriation and compensation, as well as the enlightenment to the legislation of compensation for houses on the rural homestead in our country. The fourth part, aiming at the problems existing in the legislation of expropriation and compensation of houses on the rural homestead of our country at present, Give the perfect suggestion.
