农村集体资产管理的政府干预问题研究

【摘要】：作为农村集体经济的重要依托,农村集体资产直接关系农村社会经济的发展、农民共同富裕目标的实现以及农民应有权益的保护,由此决定,实现农村集体资产的有效管理至关重要。管理好、使用好农村集体资产,对于壮大农村集体经济、保持农村社会稳定、维护农民合法权益、增加农民财产性收入具有十分重要的意义。2016年12月,中共中央、国务院所联合发布的《关于稳步推进农村集体产权制度改革的意见》对“农村集体资产管理”问题作出专门性规定,并从开展资产清产核资、明确集体资产所有权、强化农村集体资产财务管理等方面对全面加强农村集体资产管理问题作出明确要求。但从目前的实际情况来看,在很多农村地区,受农村民主自治水平不高、机制体制建设滞后等因素所限,农村集体资产管理所存在的问题还十分突出,总体来看,管理水平低下、制度保障不力,亟待规范、强化。由农村集体资产重要价值、农村集体资产管理现存问题以及政府经济管理基本职能所决定,政府应适时介入农村集体资产管理,以提升农村集体资产管理水平、促进农村集体资产保值增值,进而促进农村社会经济发展和农民应有权益保护。从实践来看,政府对于农村集体资产管理的介入产生了相应积极效应。本文首先对农村集体资产及其管理的概念进行阐述,通过分析现阶段农村集体资产管理存在的问题,探讨农村集体资产管理的政府干预的必要性,继而考察农村集体资产管理政府干预的现状,研究现行的政府干预农村集体资产的路径,对政府干预路径进行考量,并提出完善政府干预路径的建议。论文第一章为绪论,主要写本文的研究背景和意义、现有有关研究的述评以及研究的方法,最后写本文的创新和不足之处;第二章写农村集体资产及其管理的理论概述,包括农村集体资产的内涵、范围、形成、价值和特点,最后分析农村集体资产管理的意义;第三章探讨政府干预农村集体资产管理必要性,从当前农村集体资产管理存在的问题和政府的经济管理职能两方面来分析;第四章是对农村集体资产管理政府干预的现状考察,归纳了我国现行的政府干预农村集体资产管理的一般路径,分析了实践中政府干预农村集体资产管理产生的积极效应和存在的问题;第五章主要写政府对农村集体资产管理干预路径完善的建议,首先探讨了政府干预农村集体资产管理应遵循的基本原则,继而提出分类处置的基本思路,最后从政府干预的具体措施方面,提出相关的完善建议。
[Abstract]:As an important support of rural collective economy, rural collective assets are directly related to the development of rural society and economy, the realization of farmers' common prosperity goal and the protection of peasants' rights and interests. It is very important to realize the effective management of rural collective assets. It is of great significance to properly manage and make good use of rural collective assets to strengthen the rural collective economy, maintain social stability in rural areas, safeguard the legitimate rights and interests of farmers, and increase peasants' property income. In December 2016, the CPC Central Committee, The opinions on steadily promoting the Reform of the Rural Collective property right system, jointly issued by the State Council, make special provisions on the issue of "rural collective asset management," and make clear the ownership of collective assets from the perspective of carrying out asset liquidation, Strengthening the financial management of rural collective assets and other aspects of the overall strengthening of rural collective assets management made clear requirements. But from the current actual situation, in many rural areas, due to the low level of democratic autonomy in rural areas and the lagging of institutional construction and other factors, the problems existing in the management of rural collective assets are still very prominent. Generally speaking, The management level is low, the system safeguard is weak, needs to standardize urgently, strengthens. Determined by the important value of rural collective assets, the existing problems of rural collective asset management and the basic functions of government economic management, the government should intervene in rural collective asset management in good time in order to improve the level of rural collective asset management. Promote rural collective assets to maintain and increase value, and then promote rural social and economic development and the protection of farmers' rights and interests. In practice, the government's intervention in rural collective asset management has produced a corresponding positive effect. This paper first expounds the concept of rural collective assets and its management, and discusses the necessity of government intervention in rural collective asset management by analyzing the problems existing in rural collective asset management at the present stage. Then it investigates the current situation of government intervention in rural collective assets management, studies the current path of government intervention in rural collective assets, considers the path of government intervention, and puts forward some suggestions to improve the path of government intervention. The first chapter is the introduction, mainly writing the research background and significance of this paper, the review of the existing research and research methods, and finally, the innovation and deficiency of this paper; the second chapter describes the theory of rural collective assets and its management. It includes the connotation, scope, formation, value and characteristics of rural collective assets, and finally analyzes the significance of rural collective asset management. Chapter three discusses the necessity of government intervention in rural collective asset management. From the current problems of rural collective asset management and the economic management functions of the government, the fourth chapter is to examine the current situation of government intervention in rural collective asset management. This paper summarizes the current path of government intervention in rural collective asset management, and analyzes the positive effects and existing problems of government intervention in rural collective asset management in practice. The fifth chapter mainly writes the government to the countryside collective assets management intervention path consummation suggestion, first discussed the government intervention countryside collective assets management should follow the basic principle, then proposed the classification disposition basic idea. Finally, from the government intervention specific measures, put forward the relevant improvement suggestions.
