土地征收社会稳定风险评估体系规范化研究

【摘要】：随着经济社会的发展,土地征收行为越来越频繁发生。近年来因违法征收、暴力拆迁等引发的群众上访和群体性事件屡见不鲜。我国征地尤其独特性和复杂性,2010年因农村土地征收、城镇房屋拆迁引发的群体性事件就占群体性事件总量的20%,已经成为影响社会稳定的重大隐患,制约着我国新型城镇化发展进程,在土地征收项目决策中进行风险评估机制显得尤为重要。社会稳定风险评估制度由于在我国起步较晚且发展时间也不长,社会稳定风险评估机制缺乏系统科学的理论支撑,亟需多学科的理论与方法来指导。国内在风险社会的大背景下,社会矛盾频发,由于社会稳定风险评估一般都涉及公众的切身利益,给我国传统风险评估方式带来了严峻的挑战。从源头识别并筛选风险点,转变决策主体的决策理念,优化政府决策成本,促进国家权力与公民权利间的协作平衡,建立规范化的土地征收社会稳定风险评估制度显得尤为重要。构建土地征收社会稳定风险评估体系,用科学方法和手段对土地社会稳定风险进行分析预测、研判评估,及时发现影响社会稳定的隐患,采取有效措施从源头上预防、减少和化解社会稳定风险,对顺利实施土地征收、保持社会稳定具有重要的现实意义和指导意义。就目前社会稳定风险评估体系来说,存在缺少权威性的政策文本、指标体系构建缺乏定量评级研究、评估主体职能定位不清晰、评估程序结构不合理、未建立及时应急预警和保障机制等问题严重羁绊该项制度的运行,阻碍了整套制度进程的发展。所以笔者通过纵向分析国内各省市土地征收风险评估的实践经验,横向对比国内外国内外就风险管理实践,并借鉴其他国家及丰富经验,完善了六步评估程序、建立了风险应急预警机制、明确了多元化评估主体职责等内容,提升征地风险评估体系的规范性。全文主要分为五个部分:绪论部分对土地征收社会稳定风险评估的研究背景及选题意义、国内实践状况及研究现状、国外实践现状以及论文的研究路线与方式、主要内容和论文创新点进行简述。第一章土地征收社会稳定风险评估机制的根本理论。主要阐述了研究的理论基础和风险评估体系具体内容概述;第二章是土地征收社会稳定风险评估体系实践考察和评析。主要对遂宁、铜仁和淮安模式进行研究并总结他们的共同点及问题;第三章是域外风险管理经验。主要对美国风险评估指标体系、英国伦敦城市风险评估体系、欧盟食物安全保障风险评估机制进行研究并进行述评。第四章提升土地征收社会稳定风险评估体系规范性的建议。主要从完善立法体系、明确评估主体职能、科学风险识别、完善评估程序和建立风险预警保障机制几个方面进行阐述。
[Abstract]:With the development of the economy and society, the land expropriation is more and more frequent. In recent years, there are many public visits and mass incidents caused by illegal expropriation and violent demolition. The land expropriation in China is especially unique and complex. In 2010, the collection of rural land, the mass incidents caused by urban housing demolition, accounted for the total mass events. 20%, has become a major hidden danger affecting social stability. It restricts the development of new urbanization in China. It is very important to carry out risk assessment mechanism in the decision-making of land expropriation project. The system of social stability risk assessment is lack of systematic science due to the late start of the social stability risk assessment system and the low development time in our country. The theory and methods of multidisciplinary are urgently needed to guide them. In the background of the risk society, the social contradictions are frequent. The risk assessment of social stability generally involves the vital interests of the public, which brings a severe challenge to the traditional risk assessment method in our country. It is particularly important to set up a standardized risk assessment system for social stability of land expropriation, to establish a standardized risk assessment system for social stability of land expropriation, to analyze and predict the risk of social stability by scientific methods and means, and to evaluate and evaluate the risk of social stability in soil and land. To find out the hidden dangers of social stability in time, to take effective measures to prevent from the source, to reduce and dissolve the risk of social stability, is of great practical and guiding significance to the smooth implementation of land expropriation and to maintain social stability. Therefore, the author analyzes the practical experience of the land expropriation risk assessment in the provinces and cities in the country. By comparing the risk management practice both inside and outside China and abroad, and drawing on the experience of other countries and rich experience, the six step evaluation procedure has been perfected, the risk emergency warning mechanism is set up, the responsibility of the diversification evaluation main body is clarified, and the standardization of the land expropriation risk assessment system is promoted. The whole article is divided into five parts: the exordium on land expropriation The research background and the significance of the risk assessment of social stability, the status of domestic practice and research status, the current situation of foreign practice, the research route and method of the thesis, the main contents and the innovation points of the paper. Chapter 1 the fundamental theory of the risk assessment mechanism of the social stability of land expropriation. The theoretical basis and risk of the study are mainly expounded. The second chapter is an overview of the concrete content of the evaluation system; the second chapter is the practice investigation and evaluation of the risk assessment system for the land expropriation of social stability. It mainly studies the models of Suining, Tongren and Huaian and sums up their common points and problems; the third chapter is the experience of foreign risk management. The evaluation system of the risk assessment system of the EU's food safety guarantee is studied and reviewed. The fourth chapter is to improve the normative suggestions of the risk assessment system for the land expropriation of social stability. It mainly from the improvement of the legislative system, the clear evaluation of the main function of the subject, the identification of scientific risk, the improvement of the evaluation procedure and the establishment of the risk early warning guarantee mechanism.
