我国农村土地流转中的三方协调

【摘要】：农村土地流转是指在村集体范围内,拥有土地承包经营权的农户,在保留农地承包权的前提下,将土地的使用权转让给其他农户或经济组织,从而实现农地适度规模经营的行为。政府、农户和资本是土地流转中的三大主体,本文将法团主义理论中探讨“劳资”关系的三方协调机制,引入到土地流转的讨论中,通过对嘉兴洪合镇和崇明仙桥村的实地调查,以及网上相关资料的搜集,分析了土地流转中政府、农户和资本三方之间的关系,认为和谐的三方关系是土地顺利流转的前提,而要保证三方协调机制的有序运行,则需要作为中介组织的村委会在其中发挥沟通与协调的作用。本文的内容主要分为三个部分:第一部分绪论,主要涉及本文的研究问题、研究方法与资料来源、论文结构安排、研究意义、文章的创新点与不足等内容。第二部分正文,主要包括五大方面:一、文献回顾和理论框架。二、我国土地流转的历史发展过程,当前土地流转的主要方式和典型模式。三、通过所掌握的相关材料,分析政府、农民和资本三方在土地流转中的角色定位。四、主要分析政府、农户和资本三方在进行土地流转时所面临的困难。五、土地流转的中介组织,村委会是土地流转中不可或缺的中介组织,土地的顺利流转需要积极有为的村委会。第三部分是结论。在对论文前面章节分析提炼的基础上,本文认为和谐的三方关系,是土地顺利流转的前提,而三方关系的和谐,不仅需要政府为土地流转提供良好的制度和市场环境,更需要一个积极有为的村委会发挥协调作用,把政府的土地流转政策落实到基层,合理反映农民的需求,同时将分散的小农组织起来,提高农民在与资本协商过程中集体谈判的能力,维护自身的土地权益。
[Abstract]:The transfer of rural land refers to the transfer of the right to use the land to other farmers or economic organizations on the premise of retaining the right to contract and manage the land within the collective scope of the village. In order to realize the behavior of moderate scale management of agricultural land. The government, peasant household and capital are the three main bodies in the land circulation. This paper discusses the tripartite coordination mechanism of "labor and capital" in the theory of corporation, and introduces it into the discussion of land circulation. Through the field investigation of Honghe Town and Xianqiao Village of Chongming in Jiaxing, as well as the collection of related information on the Internet, this paper analyzes the relationship among the government, farmers and capital in the land circulation, and thinks that the harmonious tripartite relationship is the premise of the smooth circulation of land. In order to ensure the orderly operation of the tripartite coordination mechanism, the village committee, as an intermediary organization, should play the role of communication and coordination. The content of this paper is mainly divided into three parts: the first part is the introduction, which mainly involves the research problems, research methods and sources, the structure of the paper, the significance of the research, the innovation and deficiency of the article, and so on. The second part mainly includes five aspects: first, literature review and theoretical framework. Second, the historical development process of land circulation, the main mode and typical mode of land circulation. Third, analyze the role of government, farmers and capital in land circulation. Fourth, mainly analyzes the government, the farmer and the capital tripartite in carries on the land circulation the difficulty. Fifth, the intermediary organization of land circulation, village committee is an indispensable intermediary organization in land circulation, the smooth circulation of land needs active and active village committee. The third part is the conclusion. On the basis of analyzing and refining the previous chapters of the paper, this paper thinks that harmonious tripartite relationship is the premise of smooth land circulation, and the harmonious tripartite relationship not only needs the government to provide good system and market environment for land circulation, What is more, it needs an active and promising village committee to play a coordinating role in implementing the government's land transfer policy to the grass-roots level, so as to rationally reflect the needs of farmers, and at the same time organize the scattered small farmers. Improve farmers' collective bargaining ability in the process of consultation with capital and safeguard their land rights and interests.
