农村集体建设用地入市流转问题研究

【摘要】:农村集体建设用地入市意义深远,十分必要,是发挥社会主义市场经济、提高农民收入、促进城市化、保护耕地、深化士地制度改革的必然选择。结合农村集体建设用地内涵解析我国农村集体建设用地利用现状。当前,利用产出率低、违法用地现象普遍、土地产权模糊、权属管理混乱是我国农村集体建设用地利用存在的主要问题。以地租地价理论、土地产权理论、制度变迁理论、市场经济理论等相关理论为基础,深入分析我国农村集体建设用地入市流转发展现状、存在问题及入市流转背后深刻动因,指出入市流转是我国土地制度改革的一次重要创新。从基础模式、国家政策支撑、技术路线、入市成功案例四大方面论述农村集体建设用地入市的可行性,深入分析入市过程中各方参与主体的收益状况,运用地租地价理论与实证分析法分别针对入市前、入市中、入市后的收益状况进行纵向比较,指出收益分配应以保障农民权益为优先。从明晰土地产权、加强土地法制建设、清理隐形交易市场、规范入市流转各项制度、完善收益分配机制、配套措施的建立六个方面提出解决途径以实现农村集体建设用地的顺利入市。
[Abstract]:The rural collective construction land has far-reaching significance and is very necessary. It is the inevitable choice to give full play to the socialist market economy, raise farmers' income, promote urbanization, protect cultivated land and deepen the reform of land system. Combine the connotation of rural collective construction land to analyze the current situation of rural collective construction land use in China. At present, the main problems of rural collective construction land use in our country are low utilization rate, common illegal land use, fuzzy land property right and confusion of ownership management. Based on the theories of land rent and land price, land property right, institutional change and market economy, this paper analyzes the present situation of the circulation of the rural collective construction land, the problems and the profound reasons behind the circulation of the rural collective construction land. It is pointed out that the circulation of entering the market is an important innovation in the reform of land system in China. This paper discusses the feasibility of entering the market of rural collective construction land from four aspects: basic mode, national policy support, technical route, successful case of entering the market, and deeply analyzes the income situation of the main parties involved in the process of entering the market. By means of land rent and land price theory and empirical analysis, this paper makes a longitudinal comparison of the income situation before, during and after entering the market, and points out that the priority of income distribution should be to protect farmers' rights and interests. In order to clarify land property rights, strengthen the construction of land legal system, clean up the invisible trading market, standardize the various systems for the circulation of the market, and improve the mechanism of income distribution, In order to realize the smooth entry of rural collective construction land, six aspects of supporting measures are put forward.
