宅基地使用权确权及路径指向——基于多源流理论的分析范式

【摘要】：运用多源流理论构建宅基地使用权确权的分析框架,探讨宅基地使用权确权工作现实、政策与政治等问题,从而为完善宅基地使用权和收益权权能等政策制定提供参考和借鉴。采用了文献法,实地调研法,访谈法等对江苏省10市进行实地调研,结果发现:宅基地使用权确权发证率低以及确权工作受诸多因素的影响,宅基地使用权确权还存在着历史界限不清晰、登记主体模糊、实践操作程序不规范、"户宅不均"、"面积不等"、专业技术人才缺乏和工作经费投入不足等现实困境;已颁布的法律还存在着条文间的相互矛盾、"户"的界定不统一、宅基地面积计算方法多样化、宅基地使用权流转标准苛刻等体制局限;农户认知水平与情绪、利益相关者意愿以及政府态度与行动策略等利益失衡的影响。由此,以不动产登记为契机,围绕三大源流,从政策支持机制、法律规范机制、监督动员机制三大策略着手,提出了宅基地使用权确权工作的政策建议。
[Abstract]:Based on the multi-source theory, this paper constructs the analysis framework of the right to use the homestead, and probes into the practical work, policy and politics of the right to the use of the homestead, so as to provide reference and reference for improving the policy formulation of the right to use the homestead and the right to benefit. Through the field investigation of 10 cities in Jiangsu Province, it is found that the low issuance rate of the right to use the homestead and the influence of many factors on the work of confirming the right to use the homestead are affected by the methods of literature, field investigation and interview. There are still some practical difficulties such as unclear historical boundary, vague registration subject, irregular practical operation procedure, uneven household residence, unequal area, lack of professional and technical personnel and insufficient investment in work. There are some institutional limitations in the laws that have been promulgated, such as the contradiction between the provisions, the disunity of the definition of "household", the diversification of the calculation methods of the homestead area, the exacting standards of the circulation of the right to use the homestead, the level of cognition and the emotion of the farmers, and so on. The influence of interest imbalance, such as stakeholder will and government attitude and action strategy. Therefore, taking the real estate registration as the turning point, focusing on the three major sources, starting from the policy support mechanism, the legal normative mechanism and the supervision and mobilization mechanism, the paper puts forward the policy recommendations on the right to use the homestead.
