商洛市商州区征地区片综合地价研究

【摘要】:多年以来,我国在实行征地区片综合地价过程中,征地补偿标准有了一定的提高,这在一定程度上缓解了我国征地中存在的一些问题,但现实生活中,某些地区依然存在征地补偿标准不合理的问题,因此对征地区片综合地价进行研究具有重要的现实意义。本研究拟解决以下几个主要问题:①确定合理的征地补偿标准,提高征地补偿标准的科学性;②建立保障农民的合法权益、保证失地农民生活水平有提高、生活质量不降低的征地区片综合地价体系;③实现征地政务工作公开公正、公众参与和监督,做到征地过程中同地同价和征地补偿标准的公平性;④建立和谐稳定社会和促进经济的快速发展,以及保证城乡协调发展的征地体制与机制;⑤实现地价间平衡,同时为以后平衡研究提供思路,避免相邻地区地价悬殊情况的发生。在阐述国内外征地补偿标准研究现状,评述包括既得权利说、特别牺牲论、人本说等征地补偿理论,以及讨论包括地租理论、地价理论、土地生产力理论等征地补偿标准制定理论的基础上,解析了征地区片综合地价的相关概念,阐明征地区片划分原则、方法及制定征地区片综合地价的原则;并以此为出发点,对商州区的征地区片进行了划分,并采用案例比较法及年产值倍数法测算商州区征地区片综合地价;最后,对测算结果进行内外部验证与平衡。通过以上研究,本文证实了商州区征地区片综合地价测算结果内部合理性;并将测算结果与征地区片范围外统一年产值补偿标准进行平衡分析,发现征地区综合地价与统一年产值补偿标准过渡和衔接较平稳,从而为下一轮商州区征地区片综合地价的更新提供参考依据,使其更具科学性、合理性。
[Abstract]:Over the years, the compensation standard for land requisition has been improved in the course of the comprehensive land price collection in China, which to a certain extent alleviates some problems existing in the land requisition in China, but in real life, In some areas, the compensation standard of land expropriation is still unreasonable, so it is of great practical significance to study the comprehensive land price in some areas. This study intends to solve the following main problems: 1. To determine reasonable compensation standards for land requisition, to improve the scientific standard of compensation for land requisition. 2 to establish and protect the legitimate rights and interests of farmers and to ensure that the living standards of landless farmers are improved. The comprehensive land price system of land expropriation, which does not reduce the quality of life, realizes the openness and justice of land expropriation, public participation and supervision, and the fairness of the same price and compensation standard in the process of land requisition. (4) to establish a harmonious and stable society and to promote the rapid development of economy, and to ensure the balance of land price between the land expropriation system and the mechanism of coordinated development of urban and rural areas. Avoid the occurrence of disparity of land price in adjacent areas. This paper expounds the present situation of the research on the standard of compensation for land expropriation at home and abroad, including the theory of acquired rights, the theory of special sacrifice, the theory of compensation for land expropriation, and the theory of compensation for land expropriation, including the theory of land rent and the theory of land price. On the basis of the theory of compensation standard for land expropriation such as the theory of land productivity, this paper analyzes the related concepts of integrated land price, expounds the principle, method and principle of drawing up the comprehensive land price of land expropriation area, and takes this as the starting point. In this paper, the area of Shangzhou district is divided, and the comprehensive land price is calculated by case comparison method and annual output value multiple method. Finally, the internal and external verification and balance of the calculation results are carried out. Through the above research, this paper confirms the internal rationality of the result of comprehensive land price calculation in Shangzhou District, and analyzes the balance between the calculation result and the unified annual output value compensation standard outside the area. It is found that the transition and connection between the comprehensive land price in the levy area and the unified annual output value compensation standard are relatively stable, thus providing a reference basis for the renewal of the comprehensive land price in the next round of Shangzhou district, making it more scientific and reasonable.
