我国地方政府对危化品生产企业监管职能完善研究
[Abstract]:With the rapid development of chemical industry in China, the production and application of hazardous chemicals are becoming more and more extensive, and the safety management of hazardous chemicals has gradually become a more and more concerned social problem. In recent years, although China has initially established a dangerous chemical safety management system, however, the situation of hazardous chemical safety management is still grim, and various accidents still occur in the field of hazardous chemicals safety management. It seriously threatens the safety of people's life and property, affects the sustainable development of social economy and hinders the construction of harmonious society. According to relevant statistics: from January 2013 to January 2016, there were 3161 accidents of all kinds of dangerous chemicals in China, with an average of 2.3 accidents per day, resulting in 3534 deaths and nearly 10,000 injuries. An explosion occurred in Shandong Jinlan Chemical Development Co., Ltd in Lanshan District, Linqi City, killing 18 people and injuring 10 others, and causing direct economic losses of more than 7 million yuan; on August 15, 2015, A toluene storage tank in Changzhou Xindong Chemical Industry Development Co., Ltd. exploded in Changzhou Binjiang Chemical Park, Jiangsu Province, killing 15 people and injuring 74 others. It is true that there are many reasons for the above hazardous chemical accidents, but the government is duty-bound to have some problems in the safety management of hazardous chemicals. How to improve the regulatory functions of local governments in this respect? It has become an urgent and realistic topic which needs the constant attention of the country (society) and even the theorists. Academic circles are not willing to lag behind, to this launched a series of studies, the results are more fruitful, but after all, from the requirements of the country, the actual needs, there is still not a small gap, need to continue to study. In view of this, this paper intends to start with the study of the regulatory function of local governments in the safety management of dangerous chemicals, combining the ideas of "Internet safety supervision" from three aspects: the main body, the content and the means of supervision. In order to strengthen the safety management of dangerous chemicals in our country, the government should seek to perfect the supervision function of the government in the safety management of dangerous chemicals, and realize the supervision from "civil air defense" to "technical prevention" in order to strengthen the safety management of dangerous chemicals in our country. On the basis of studying the current production management policies of hazardous chemicals in China and mastering the research trends of domestic and foreign academic circles, according to the relevant theories of market supervision and other relevant theories, literature research, comparative research and other methods are used. There are seven chapters about this topic: the first chapter mainly explains the basis of this thesis and the logical premise of writing; the second chapter, This paper expounds the history and practice of the supervision function of local government in the production and management of dangerous chemicals, the third chapter analyzes the main body of local government supervision in the production and management of dangerous chemicals. In the fourth chapter, we analyze the content of local government supervision in the production and management of hazardous chemicals, and then compare the differences and analyze the reasons. The fifth chapter, the local governments in the management of hazardous chemicals production and management should be and actual analysis, so as to compare the differences, and analyze the reasons for this; in the sixth chapter, In view of the problems existing in the supervision and management of dangerous chemicals production by local governments in our country at present, this paper puts forward some reasonable countermeasures; the seventh chapter is the conclusion.
