舟山市普陀区房屋用途临时变更政策研究

【摘要】：舟山市普陀区房屋用途临时变更现象非常普遍,在老城区中尤甚。适时适度的临时变更不仅能节约城市资源、快速促进城市更新,更能为存量规划的发展提供新的思路。然而,普陀区已审批的变更案例研究表明,目前临时变更管理中存在变更随意、审批不严、有碍民生及资源浪费等主要问题。借鉴国内外相关管理经验,讨论普陀区临时变更管理的政策设计。指出,把房屋用途变更管理作为法定控规弹性的一项重要补充,有利于为房屋用途临时变更提供法定依据,对推动我国控规编制理念的转型和存量规划的发展具有积极的意义。
[Abstract]:Temporary changes in housing use in Putuo District, Zhoushan City, are very common, especially in old urban areas. Timely and moderate temporary change can not only save urban resources, promote urban renewal quickly, but also provide new ideas for the development of stock planning. However, the case studies on the changes approved in Putuo District show that there are some major problems in the temporary change management, such as arbitrary changes, lax approval, obstruction of people's livelihood and waste of resources, and so on. This paper discusses the policy design of temporary change management in Putuo District based on relevant management experience at home and abroad. It is pointed out that taking the management of house use change as an important supplement to the flexibility of statutory control rules is beneficial to provide the legal basis for the temporary change of house use and has a positive significance in promoting the transformation of the concept of control and planning and the development of stock planning in China.
