基于权力视角的冲突分析建模体系研究

【摘要】:建筑工程往往涉及多方利益体,而各个利益主体的利益诉求往往不一致,从而出现各类工程纠纷,由此常会导致工程延误、社会关系破坏等问题,影响到社会的和谐稳定。大量研究成果表明,基于博弈论发展而来的偏对策与冲突分析理论,对解决各类工程纠纷是行之有效的。然而,传统的偏对策与冲突分析理论在分析具体纠纷问题时,当事者之间的权力差异要么完全未被考虑,要么有被研究人员模糊考虑,但不准确、全面。这使得根据模型得到的均衡解或者对现实缺乏足够的解释力,或者在实际纠纷中不为权力强势方所接受。本文旨在通过考虑权力对纠纷主体产生的各种影响,对传统的偏对策与冲突分析模型进行修正,建立基于权力视角的冲突分析模型体系。 本研究首先对工程纠纷中的权力及其属性予以界定,同时对建筑工程纠纷中的权力属性进行了分析; 其次,根据权力的定义及属性,识别出纠纷中常见的八种权力类型;通过对三类权力成本及纠纷主体权力风险偏好的分析,建立纠纷主体判断各方权力大小的权力判断模型。同时基于社会心理学的研究成果,以实际工程纠纷为对象,对工程纠纷中权力对纠纷主体的心理和行为产生影响的三类效应进行分析。 然后,根据权力判断模型,通过提取纠纷中的权力信息,实现对纠纷的权力阶段划分;在各个权力阶段内,依次通过对纠纷干系人及非干系人的特征分析,分离出纠纷中的当事者、支援者以及介入者。进而对比该三类干系人与局中人的特征,设定识别准则,从而确定冲突分析模型的局中人;通过分析纠纷的利益争点以及局中人的权力状态,从而完成各局中人的策略设定;通过分析局中人策略间的相互关系,识别出纠纷中的不可行策略组合类型,同时通过考虑权力效应,设置相应的调整规则,进而完成可行局势的设定;根据各可行局势的效用值序列,确定出局中人的纯效用偏好,再通过考虑权力效应,建立偏好修正规则,得到局中人基于权力视角的偏好序列;在上述各要素确定的基础上,进行稳定性分析,从而完成基于权力视角的冲突分析模型体系构建。 最后,以现实拆迁纠纷为例,对基于权力视角的冲突分析模型体系的有效性进行了验证。
[Abstract]:Construction projects often involve multiple interests, but the interests of the main interests of the demands are often inconsistent, resulting in a variety of engineering disputes, which often lead to delays in the project, social damage and other issues, affecting the social harmony and stability. A large number of research results show that the game theory based on the development of partial countermeasures and conflict analysis theory is effective to solve all kinds of engineering disputes. However, when the traditional partial game and conflict analysis theory analyze the specific dispute, the power difference between the parties is either completely ignored or vaguely considered by the researchers, but it is inaccurate and comprehensive. This makes the equilibrium solution based on the model either lack sufficient explanation to the reality or is not accepted by the powerful power side in the actual dispute. This paper aims to set up a conflict analysis model system based on the perspective of power by considering the influence of power on the main body of the dispute and modifying the traditional partial countermeasures and conflict analysis model. Firstly, this study defines the power and its attribute in the engineering dispute, and analyzes the power attribute in the construction dispute. Secondly, according to the definition and attribute of the power, Through the analysis of the three kinds of power cost and the risk preference of the power of the dispute subject, the power judgment model of the dispute subject to judge the power of each party is established. At the same time, based on the research results of social psychology, this paper analyzes the three kinds of effects of power on the psychology and behavior of the subject in the actual engineering dispute, taking the actual engineering dispute as the object. Then, according to the power judgment model, by extracting the power information in the dispute, the power phase of the dispute can be divided. Separate out the parties, supporters, and interventioners in the dispute. Then, by comparing the characteristics of the three kinds of stakeholders and the people in the bureau, setting the identification criteria, determining the person in the bureau of the conflict analysis model, by analyzing the points of interest contention in the dispute and the power state of the person in the bureau, the strategy setting of the person in each bureau can be completed. By analyzing the relationship between the tactics of people in the bureau, we can identify the combination types of infeasible strategies in the disputes, and set up the corresponding adjustment rules by considering the power effect, and then complete the setting of feasible situations. According to the utility value sequence of each feasible situation, the pure utility preference of the outgoing person is determined, and then by considering the power effect, the preference correction rule is established, and the preference sequence based on the power perspective is obtained. Stability analysis is carried out to build the conflict analysis model system based on power perspective. Finally, the validity of the conflict analysis model based on power perspective is verified by taking the real demolition dispute as an example.
