论我国的个人信息保护模式

【摘要】：本文通过作者自身的一次买房经历所引发的对于个人信息保护现状的焦虑和中国个人信息保护模式的思索。应该来说个人信息保护并不能算是新概念，只是信息时代的到来，，使人们在采集个人信息，以及通过大型数据库和搜索引擎快速搜寻信息的能力大大提高，个人信息也具有了前未有过的商业价值和社会价值，因此才越来越引起人们的关注。信息化在给我们带来便利的同时，也对个人信息保护提出了新挑战，它对个人信息权的侵害是多样化的。为了更好地在信息时代保护个人信息安全，首先，笔者对我国目前在个人信息保护的现状进行梳理，进行现状分析，从三个角度（法律保护、自律机制和第三方保护）进行详尽地介绍；最后对其不足进行评价和成因分析。其次，对欧盟、美国和日本个人信息保护的模式进行具体阐述,看看他们的做法对我国是否有借鉴意义。鉴于学界已对欧盟和美国个人信息保护模式做了诸多分析，将重点放在二者有所区别的政治、经济和文化根源上，同时对集欧美之长的日本个人信息保护模式做了重点分析。最终通过比较，进行评价和成因分析，并研究三个保护模式在信息社会不同发展阶段的适用性。最后借助前面的中国现状分析和国外经验的借鉴，分几个方面进行展开论述和探索适合中国国情的信息保护模式。
[Abstract]:In this paper, the author's anxiety about the current situation of personal information protection and the thinking about the mode of personal information protection caused by the author's own experience of buying a house. It should be said that personal information protection is not a new concept, but the arrival of the information age, so that people in the collection of personal information, and through large databases and search engines to quickly search for information greatly improved. Personal information also has the commercial value and social value that have never been before, so people pay more and more attention to it. Information technology not only brings convenience to us, but also brings new challenge to personal information protection. Its infringement on the right to personal information is diverse. In order to better protect personal information security in the information age, first of all, the author combs the present situation of personal information protection in our country, carries on the present situation analysis, from three angles (legal protection, Self-discipline mechanism and third-party protection are introduced in detail. Secondly, the models of personal information protection in the EU, the United States and Japan are elaborated in detail to see if their practices are of significance to our country. In view of the fact that scholars have done a lot of analysis on the models of personal information protection in the EU and the United States, Focusing on the political, economic and cultural roots of the two differences, and at the same time making a key analysis of the Japanese personal information protection model, which combines Europe and the United States, finally, through comparison, the evaluation and cause analysis are carried out. And study the applicability of three protection models in different stages of information society development. Finally, with the help of the analysis of China's current situation and the experience of foreign countries, this paper discusses and explores the information protection mode suitable for China's national conditions in several aspects.
