搜索引擎竞价排名法律规制研究

【摘要】:互联网广告影响着我们的生活。伴随着计算机网络的发展,现代人通过搜索获得想要的内容,竞价排名作为一种新型的搜索技术给我们的生活带来了许多改变。搜索引擎商通过给广告商提供竞价排名服务,从而获得巨大的利益。但是,近年来,以百度为代表的搜索引擎商,因为竞价排名业务频繁遭遇诉讼。因为竞价排名是一把双刃剑,带来巨大商业利益的同时,也有着法律上的风险。2016年9月1日《互联网广告暂行管理办法》的施行,明确规定了竞价排名属于广告,这是我国首次在法律上定义竞价排名。本论文从法律的视角着重阐述了搜索引擎竞价排名的概念,还有相应的法律规制。我国目前关于竞价排名的法律仍然不够完善,对于竞价排名的违法行为,也没有相应具体的处罚措施。本文的核心在于描述如何完善竞价排名的相关法律。本文分为五章,主要从概念界定、基本原理、法律制度上研究竞价排名问题。第一章为绪论。主要介绍了有关竞价排名的选题背景,国内外发展现状,还有本论文的研究价值。由最近发生的“魏则西事件”和“美团外卖事件”为背景引出竞价排名中出现的审查门槛低、相关部门监管不严格的问题。通过对国内外研究现状进行综述,我们可以了解目前国内外关于搜索引擎竞价排名的研究主要集中在讨论竞价排名的侵权问题。第二章是竞价排名的法律分析。竞价排名具有目标明确,广告灵活性强,价格低廉的特征。本文还明确了竞价排名在法律上的性质为广告,竞价排名应当和自然搜索明显区分,所以它受到《广告法》及相关法律法规规制,这对于全面了解竞价排名有十分重要的意义。竞价排名中主要有虚假关键词、广告主服务违法、商标侵权行为、点击欺诈行为等违法行为。第三章为竞价排名法律规制的路径选择和作用机制。这是通过竞价排名在法律中的权利义务的配置来实现的。有关竞价排名的法律规制分为《互联网广告管理暂行办法》、《商标法》、《反不正当竞争法》等。规制竞价排名的法律原则主要有诚实信用原则、真实性原则、过错责任原则等。第四章为我国规制竞价排名中存在的法律问题。主要包括法律主体模糊、竞价排名的侵权责任问题、竞价排名的实践问题。明确了搜索引擎商如果对广告主实施了帮助行为,那么搜索引擎商理应承担间接侵权的责任。也指出了在法律救济中竞价排名法律纠纷管辖难、取证难、执法难等突出的问题。第五章为完善我国竞价排名法律规制的对策建议。主要从立法、执法、司法、自身行业自律四个方面提出完善竞价排名法律规制。明确提出完善竞价排名法律规制的方法,不仅要贯彻《暂行办法》的实施,同时还要尽快制定专门规制互联网广告的法律,来实现对竞价排名违法问题的专门规制。加强对互联网侵权的执法力度,加强对工作人员的培训,建立全国范围的互联网广告监管体系,加强对互联网广告审核和监管,强化司法救济,明确按照《暂行办法》的规定规制竞价排名。
[Abstract]:Internet ads affect our lives. With the development of computer network, modern people have obtained the desired content by searching, and the ranking of the bidding price has brought many changes to our life as a new search technology. The search engine has obtained great benefits by providing an advertiser with a bid ranking service. However, in recent years, Baidu is the representative of the search engine, because the ranking business of the bidding price frequently encounters the lawsuit. Since the ranking of the bidding price is a double-edged sword, it also has the legal risk. On September 1, 2016, the implementation of the provisional management method of the Internet advertisement clearly specifies that the non-competitive ranking belongs to the advertisement, which is the first legal definition of the competitive price ranking in China. From the perspective of law, this thesis focuses on the concept of search engine race ranking, and the corresponding legal regulation. At present, the law on the ranking of the non-competitive price is still not perfect, and there is no corresponding specific punishment measure for the illegal act of the ranking of the non-competitive price. The core of this paper is to describe how to improve the relevant laws of the ranking of the competitive price. This paper is divided into five chapters, mainly from the definition, the basic principle and the legal system. The first chapter is the introduction.
