民间口头文学的著作权保护

【摘要】：非物质文化遗产是人类文明社会的一个重要组成部分,是维持文化多样性和促进文明发展的基础和源泉。民间口头文学作为非物质文化遗产的一部分,对全社会文学文化的发展具有重要意义。当前各国都普遍承认民间口头文学的巨大精神和经济价值,也大都通过立法来保存和发展民间口头文学。本文针对民间口头文学自身的性质和特征,通过对其著作权保护的可行性分析及多种保护模式的比较,赞成以著作权模式来保护民间口头文学。本文具体分为六个部分：第一部分首先对与民间口头文学相关的几个概念进行界定,即根据重要国际条约的规定,对非物质文化遗产、民间文学艺术、传统知识等概念进行立法定义。民间口头文学是上述三个概念的下位概念,通过对其上位概念的分析和关系辨别,能更好地定义民间口头文学；接下来是介绍民间口头文学的特征,本文从立法保护的角度将民间口头文学的特征概括为表达形式的立体性、创作主体的不确定性、创作过程的延续性和变异中的传承性四个方面；第二部分是对各国对民间口头文学的保护现状进行分析,先介绍国外具有代表性的相关立法规定,再介绍国内立法,国内立法又分为全国性规定和地方性规定,最终对整体状况进行分析；第三部分分析民间口头文学著作权保护的正当性,首先从作品的构成、独创性分析和可复制性三个方面来证明民间口头文学的可版权性,其次通过著作权保护模式和特别法保护模式的分析比较,确定著作权保护模式为较优选择；第四部分介绍民间口头文学的保护对象,先介绍了其从“作品”到“表达”到“整体”的演变,再从本原作品和衍生作品两个方面来分析民间口头文学的保护对象；第五部分分析民间口头文学的权利主体,从本原作品和衍生作品进行分析,同时探讨了传承人的相关地位；第六部分讨论了民间口头文学著作权的限制,先从理论方面探讨了限制制度的意义,再结合民间口头文学自身的特征进行了限制制度的立法构想,最后分析了民间口头文学著作权保护的期限,笔者认为应给予民间口头文学无期限的保护。通过全文的讨论分析,期望对以后的相关立法及对民间口头文学的保护发展有所帮助。
[Abstract]:Intangible cultural heritage is an important part of human civilization, is to maintain cultural diversity and promote the development of civilization. The foundation and source of folk oral literature as a part of intangible cultural heritage, has important significance to the development of the whole society of literature culture. Great spiritual and economic value of the countries have acknowledged the folk oral the literature, mostly through legislation to protect and develop the folk oral literature. According to the oral folk literature of its own characteristics, through the comparison of the copyright protection feasibility analysis and a variety of protection mode, agree with the mode of copyright to protect folk oral literature. This paper is divided into six parts: the first part the definition of relevant concepts and folk oral literature, which is important in accordance with the provisions of the international treaties, the intangible cultural heritage, folk literature and art With the concept of traditional knowledge. The legal definition of folk literature is the subordinate concept of these three concepts, through the analysis of the basic concept and the relations between, can better define the oral folk literature; then introduces the features of folk oral literature, this article from the angle of legislation will feature oral folk literature summary for the expression of three-dimensional form, the creation of the main uncertainty, four aspects of the creative process continuity and variability in succession; the second part is to protect the status of national folk oral literature analysis, first introduced the foreign representative of the relevant legislation, and then introduce the domestic legislation, domestic legislation is divided into provisions of national and local regulations, and ultimately the overall situation to carry on the analysis; the third part analyzes the legitimacy of folk literature copyright protection, first from the works of the structure, only Noninvasive analysis and reproducibility of three aspects to prove the copyright of folk literature, followed by analysis of copyright protection and special law protection mode, determine the copyright protection mode is a better choice; the fourth part introduces the object of protection of folk literature, first introduced it from "work" to "expression" to "the whole" the evolution of the object of protection from two aspects of primitive works and derivative works of folk literature; the fifth part analyzes the subject of the right of folk literature, carries on the analysis from the primitive works and derivative works, and discusses the related status inheritance; the sixth part discusses the folk oral literature copyright restrictions, first from the aspect of theory of the significance of the limitation of legislation, then the restriction system with its own characteristics of folk oral literature, the final analysis The deadline for the protection of the copyright of folk oral literature, I believe, should be given to the protection of folk oral literature without deadline. Through the discussion and analysis of the full text, I hope it will be helpful for the future related legislation and the protection and development of folk oral literature.
