论网络环境下著作权的合理使用制度

【摘要】：著作权的产生与发展,与人类科学技术的发展密切相关,二者互相影响、共同向前发展。事实上,著作权制度本身就是科学技术的产物。在印刷术发明之前,人们主要以抄写、讲诵的方式来传播文学艺术作品和科技作品,不存在大量的复制,因而也不存在著作权的保护问题。随着造纸技术的发明,尤其是印刷术的发明,对作品的大量而节省费用的复制成为可能,也就产生了著作权保护的必要。在我国,自宋代普遍采用雕版印刷术以后,就有了版权保护的事例。即使到了今天,基于印刷术而产生的复制权,仍然是著作权制度中的一项基本的和最重要的权利。著作权制度这个科学技术的产物,自其产生以来,它就是随着科学技术的发展而不断的发展变化。或者说,科学技术的发展总是对著作权制度不断提出挑战,而著作权制度也在应战中不断发展完善。大体说来,著作权制度应对科学技术的挑战主要体现在两个方面,一是随着科学技术的发展,产生了一些新的受保护的客体,著作权制度逐渐将它们纳入受保护的范围之中；二是随着科学技术的发展,产生了一些新的对于作品的利用方式,著作权制度逐渐将这些新的利用方式纳入著作权的范围之内。在著作权制度与科学技术的互相影响和共同向前发展的这个过程中,著作权的合理使用制度发挥着平衡著作权人和使用人之间利益的重要作用。在传统纸质媒介中,合理使用制度的作用得到了很大的体现,在教育、公益性事业以及个人使用等非营利性使用方式上为社会公众争取了很多的利益。然而,20世纪80年代以来,随着电子信息技术的飞速发展,因特网正以惊人的速度将触角延伸至人类活动的几乎所有领域,成为继报纸、广播、电视之后的“第四媒体”。伴随计算机网络技术而产生的对网络作品复制、下载、修改的便捷使著作权人大惊失色,网上一时之间成了盗版的天堂,打破了传统著作权人与使用人之间的利益平衡关系,严重冲击了著作权的合理使用制度,使传统著作权的合理使用制度面临着前所未有的巨大考验。技术保护措施的使用扭转了这一局面,但是它在充分保护了著作权人利益的同时,又几乎剥夺了公众合理接触和使用作品的所有机会,著作权法处于失衡状态。为了恢复在互联网环境下这种被打破的平衡,有必要对网络环境下的著作权的合理使用制度进行研究,合理使用制度需要适应网络环境而进行变革,从而在网络环境下维护著作权人和社会公众的合法利益,这就是研究其的目的所在。本文力求在我国现行著作权法对网络环境下合理使用制度的规定立法滞后的情况下,将针对网络环境对合理使用制度造成的冲击,结合国外立法和司法实践,对我国网络著作权保护的著作权的合理使用制度提出若干思考。
[Abstract]:The emergence and development of copyright are closely related to the development of human science and technology. They affect each other and develop together. In fact, the copyright system itself is the product of science and technology. With the invention of paper-making technology, people mainly spread literary and artistic works and scientific and technological works by copying and reciting. There are not a large number of copies, so there is no copyright protection problem. In particular, the invention of printing, the reproduction of a large number of works and save money has become possible, which has resulted in the necessity of copyright protection. In China, since the Song Dynasty, the general use of engraving printing. Even today, the right of reproduction based on printing is still one of the basic and most important rights in the copyright system. The copyright system, the product of science and technology, has been developing and changing with the development of science and technology since it came into being. In other words, the development of science and technology has always challenged the copyright system. Generally speaking, the copyright system to meet the challenges of science and technology is mainly reflected in two aspects, one is with the development of science and technology. Some new protected objects have emerged, and the copyright system has gradually brought them into the scope of protection; Second, with the development of science and technology, some new ways of using works have emerged, and the copyright system has gradually brought these new ways of use into the scope of copyright. In the process of mutual influence and common development of copyright system and science and technology. The fair use of copyright plays an important role in balancing the interests of copyright owners and users. In the traditional paper media, the role of fair use system has been greatly reflected in education. Public welfare undertakings and private use of non-profit use methods for the public to fight for a lot of interests. However, since 80s of the 20th century, with the rapid development of electronic information technology. The Internet is extending its tentacles to almost all areas of human activity at an alarming rate, becoming "4th media" after newspapers, radio and television. The convenience of downloading and modifying makes the copyright owners startled, and becomes the paradise of piracy on the Internet for a time, breaking the balance of interests between the traditional copyright owners and the users. Serious impact on the fair use of copyright system, so that the traditional fair use of copyright system is facing an unprecedented great test. The use of technical protection measures to reverse this situation. However, it not only fully protects the interests of copyright owners, but also deprives the public of all opportunities for reasonable access and use of works. Copyright law is in a state of imbalance. In order to restore this broken balance in the Internet environment, it is necessary to study the reasonable use of copyright in the network environment. Reasonable use of the system needs to adapt to the network environment and change, so as to protect the legitimate interests of copyright owners and the public in the network environment. This is the purpose of the study. This paper tries to aim at the impact of the network environment on the reasonable use system under the condition that the legislation of the current copyright law of our country on the reasonable use system under the network environment lags behind. Combined with foreign legislation and judicial practice, this paper puts forward some thoughts on the rational use system of the copyright of network copyright protection in our country.
