三网融合对著作权机制的影响研究

【摘要】：三网融合是指广播电视网、电信网、互联网在向数字电视网、宽带通信网、下一代互联网演进过程中，，通过技术改造，三大网络技术功能、业务范围趋于一致，网络互联互通、资源共享，为用户提供广播电视、语音和数据多种服务。三网融合使得网络信息量更丰富、运行速度更快、市场需求更大，作品授权的地域性减弱，以及较高的监管要求。技术的变革无疑会对法律产生影响。在广播电视网、电信网、互联网三网融合过程中，对著作权法产生较大的影响。这种影响有积极有方面，也有挑战。积极的方面表现在，会有利于作品传播渠道多元化，更好地实现著作权法的立法目的以及有利于遏制网络盗版，此外也会在一定程度上使著作权保护范围扩大。与此同时，三网融合也会带来信息网络传播权与广播权的部分重叠，打破地域限制带来的权利冲突，侵权主体扩大、海量信息以及权利主体多元使得作品更难管理等问题。对于三网融合给著作权机制带来的挑战，可以有一些应对之策，包括调整著作财产权的类型，将著作财产权重新构造成复制权、传播权和演绎权三种类型，将信息网络传播权与广播权归入到传播权中。明确限制设备生产商的侵权责任，借鉴“索尼案”的判决结果，对于“实质性非侵权用途”的设备生产商不苛以侵权责任。完善版权交易规则和机制，加大创作支持和监管力度，规范作品管理，防止权利冲突。三网融合没有触及著作权法的根基，三网融合的推进不会使著作权法的结构框架发生改变，著作权法基本框架会基本维持不变。但随着三网融合进程的推进，诸多网站在竞争中优胜劣汰，一些大的网站会脱颖而出，占据市场优势，形成垄断，自己制定规则。为了解决网络上海量作品授权问题，著作权许可模式会发生变革，可以将网络上海量作品授权纳入到法定许可的范围，也可以借鉴或援引GOOGLE数字图书馆“先使用，后付费”的模式。
[Abstract]:Integration refers to the radio and television network, telecommunication network, Internet to digital TV network, broadband communication network, next generation Internet evolution process, through technical transformation, three network technology function, the scope of business consistent, network interconnection, sharing of resources, to provide users of radio and TV, voice and data services. Triple play makes the network information richer, faster, greater market demand, weakening regional work authorization, and higher regulatory requirements.
The change of technology will certainly affect the law. Telecom in the broadcast network, network and Internet network integration process, has great impact on the copyright law. This effect has a positive aspect, is also a challenge. The positive aspects in the performance, will be conducive to the dissemination of works of the multi-channel of legislation, to better implementation of the copyright law and is conducive to curb piracy, in addition to some extent also to expand the scope of copyright protection. At the same time, the triple play will also have the right to network dissemination of information and broadcasting rights overlap and conflict break geographical restrictions caused by the infringement of the main expansion, mass information and rights makes multi subject work more difficult management problems.
For the triple play to bring copyright mechanism challenges, there can be some countermeasures, including adjusting the type of copyright, the copyright reconstructs the reproduction right, the right of communication and right of interpretation of three types, the right of information network dissemination and broadcast rights belong to the right of communication. The tort liability expressly limits production equipment taking the reference of "SONY" case verdict, the manufacturer of substantial non infringing use of harsh tort liability. The improvement of the copyright trading rules and mechanisms, increase the creation of support and supervision, standardize work management, to prevent the conflict of rights.
The foundation has touched the copyright law convergence framework, promote the triple play of the copyright law does not make the change of the basic framework of copyright law will basically remain unchanged. But as the process to promote the triple play of many sites in the competition, some big websites will dominate the market, talent shows itself, the formation of monopoly and make the rules. In order to solve the network authorization problem in Shanghai works, copyright licensing mode will change, the network can be authorized in Shanghai works into the scope of the statutory license, can also be invoked or GOOGLE digital library "first use, after pay" model.
