论著作权法上的出租权

【摘要】: 从20世纪80年代早期开始,出租电影作品、音像制品等成为利用作品与邻接权客体的重要形式。如何解决著作权与作品原件及复制件所有人享有的物权之间在出租过程中发生的权利冲突,如何实现著作权人、物权所有人与消费者之间的利益平衡,成为各国乃至整个国际知识产权界亟待解决的问题。TRIPS协议、WCT和WPPT等国际条约有关出租权的规定为各成员国建构出租权制度提供了示范性规范和最低要求。 出租权作为著作财产权一项新的权利内容,是法律赋予著作权人与相关权利人的专有权利。相对于其他著作财产权而言,其行使涉及的利益攸关方更多,权益冲突更加尖锐。立法者的态度比较谨慎。出租权的核心问题集中在对其必要性的探讨、出租权的法律构造等方面。 本文总体上分为五部分: 引言简要介绍我国法上出租权的立法过程及立法者所持的态度。 正文第一部分探讨出租权立法的必要性。出租权是数字时代平衡利益的需要,是从经济上对权利人给以补偿以求社会公正的需要;同时也是适应有关国际条约规定,履行国际义务的需要。 第二部分从客体、主体、内容、行使与限制及侵权行为等五个方面剖析出租权的法律构造。著作权客体是作品,著作权法上的出租权客体则不能生搬硬套且一概而论。著作权法上的出租权客体分为两类:著作财产权中的出租权客体和邻接权中的出租权客体。出租作品附着物过程中,出租标的决定了出租利益的归属:如果出租标的是物,目的仅在于发挥物的效用,收益归附着物物权人;如果出租标的是附着物体现的作品,收益归著作权人或相关权利人。出租权主体是指著作权法上的享有出租权的人。我国著作权法上规定的出租权对权利人采取的是适度保护原则,即赋予特定主体对特定客体享有专有出租权。我国著作权法上确认的出租权主体是著作权人或者与著作权有关的权利人。出租权的内容是指出租权的各项权能。出租权的内容决定了出租权的行使方式;出租权的行使是指权利人如何实施出租权。出租权的限制,是法律在一定条件下对出租权加以限制或者规定例外。侵害出租权的行为部分探讨侵害出租权的行为方式。 第三部分从国际组织、国际条约规定的出租权的角度探讨出租权。通过评介国际组织、国际条约规定的出租权,梳理其间的关系。 第四部分结合有关法律规定探讨我国法上出租权制度现状,指出我国法上出租权制度的不足,并提出有关完善的建议。
[Abstract]:From the beginning of the early 1980s, rent movies, audio and video products has become an important form of the works and the adjacent right object. How to solve the conflict between the copyright and the original works and copies of the property rights of all people in the rental process, how to achieve the balance of interests between copyright owners, property owners and consumers, become the problems of.TRIPS protocol and the whole world of international intellectual property rights is urgently to be solved, the rules of WCT and WPPT and other international treaties related to rental rights provides a demonstration of the specification and the minimum requirements for various members to construct the rental right system.
The rental right as a new copyright right content, is the law of copyright and related rights to exclusive rights. Comparing with other works property rights, the exercise involves stakeholders more and more sharp conflict of rights and interests of legislators. A more cautious attitude. The core problem of rental rights focus on discussion the necessity of the legal structure of the rental right and so on.
This article is divided into five parts as a whole:
The introduction gives a brief introduction to the legislative process of the renting right in China and the attitude of the legislator.
The first part of the text discusses the necessity of legislation of rental rights. The right to rent is the need of balancing interests in the digital age, the need to compensate the right people for social justice and the need to fulfill the international obligations stipulated in the relevant international treaties.
The second part from the object, subject, content, legal structure of the five aspects of exercise and restriction of tort and analysis of the rental right. The object of copyright works, the copyright law of the object of the rental right is not mechanically and generalize. Copyright law is the object of the rental right is divided into two categories: the object of the rental right and adjacency the right of property right in the object of the rental right. The third part discusses the right to lease from the perspective of international organizations and the rentals stipulated in international treaties. It reviews the relationship between international organizations and the rental rights stipulated in international treaties.
The fourth part, combined with relevant laws and regulations, discusses the status quo of the rental right system in our country, points out the shortcomings of the rental right system in our country, and puts forward some suggestions for improvement.
