我国法人作品著作权相关问题研究

【摘要】：我国《著作权法》自规定法人作品以来,理论界和司法实务界都对此制度的合理性进行了讨论。其中包括法人能否作为作者,法人是否可以享受精神权利以及法人作品与职务作品如何区分等问题。在实践中,法人作为民事主体,其对作品的投入也应该受到保护。故理清法人作品制度的内涵,不仅有利于保护法人及自然人作者的权利,也有利于整个著作权制度的构建。本文分四章进行研究。第一章:法人作品的认定及其著作权归属。本章从法人作品的概念入手,对我国《著作权法》中的法人作品进行了界定,并将其与相关作品进行了比较,明确了其法律内涵。阐述了国外关于法人作品制度的规定,剖析了作者、原始著作权人与著作权人之间的关系。从而得出:我国借鉴国外立法形成的法人作品制度,使整个著作权归属制度不够明晰,引起法人作品与职务作品、委托作品适用的交叉。第二章:我国法人作品与相关作品的区别及争议问题。本章主要通过司法实践中适用法人作品的案例讨论了我国法人作品与特殊职务作品、委托作品的区分,并进一步研究了法人能否享有精神权利,分析了以作者为核心建立的著作权保护期存在的问题。第三章:我国法人作品的由来及规定的原因分析。本章从新中国著作权保护制度的建立出发,阐述了建国以来著作权保护制度的变换,理清了我国法人作品的由来。在此基础上,剖析了我国规定法人作品的原因。第四章:我国法人作品制度的改进。本章针对前几章关于法人作品的问题,提出了改进的建议:取消法人视为作者的规定,将法人作品部分分解到职务作品和委托作品;单列需要法人享有著作权的特殊类作品;完善著作权的保护期规定。希望通过本文,能够明确法人作品的内涵和判断标准,对我国著作权制度提供一些参考。
[Abstract]:Since the regulation of legal person's works, the rationality of this system has been discussed in the theoretical and judicial circles, including whether the legal person can be the author. Whether the legal person can enjoy the spiritual right and how to distinguish the legal person's work from the duty work, etc. In practice, the legal person, as a civil subject, should also be protected from the investment in the work, so the connotation of the legal person's work system should be clarified. It is not only beneficial to protect the rights of legal person and natural person, but also beneficial to the construction of the whole copyright system. This paper is divided into four chapters. Chapter one: the identification of legal person's work and its copyright attribution. This chapter starts with the concept of legal person's work, defines the legal person's work in our country's copyright Law, and compares it with related works. This paper clarifies its legal connotation, expounds the regulations of the legal person's work system abroad, analyzes the relationship between the author, the original copyright owner and the copyright owner, and draws the conclusion that our country draws lessons from the legal person's work system formed by the foreign legislation. The whole system of copyright ownership is not clear enough, which leads to the cross between the legal person's work and the duty work and the commissioned work. Chapter two: the differences and disputes between the works of legal person and related works in our country. This chapter mainly discusses the distinction between the works of legal persons and the works of special duties and entrustment works through the case of applying the works of legal persons in judicial practice. The author further studies whether the legal person can enjoy the spiritual right and analyzes the existing problems of the copyright protection period established with the author as the core. Chapter three: analysis of the origin and regulation of legal person's works in our country. This chapter starts from the establishment of copyright protection system in New China, and expounds the transformation of copyright protection system since the founding of the people's Republic of China. This paper clarifies the origin of legal person works in our country, and analyzes the reasons for the legal person works in our country. Chapter 4th: the improvement of the system of legal person works in our country. This chapter puts forward some suggestions for improvement in view of the problems of the legal person works in the previous chapters: canceling the stipulation that the legal person should be regarded as the author, and decomposing the part of the legal person's work into the official works and the commissioned works; A separate list of special works that require legal persons to enjoy copyright; perfect the term of protection of copyright. Through this article, we hope to clarify the connotation and judgment standard of the legal person's works, and provide some references for the copyright system of our country.
