【摘要】：数字图书馆代表着图书馆的未来的发展方向,一经面世即带来了巨大的生命力。许多企业为了攫取其中所潜藏的利润,纷纷注入高额的资金以期获得丰厚的回报。然而,由于数字图书馆在信息采集和传播过程中与传统图书馆有着很大的不同,导致了数字图书馆在建设过程中遇到了许多的著作权问题,这些问题成为制约数字图书馆发展的瓶颈,Google数字图书馆的建设就是其中一个典型的案例。Google数字图书馆在建设、运行过程中,在未经权利人允许的前提下复制了大量的文献资料,该公司在复制行为完成后,又利用技术手段制作了索引,使得读者(使用者)可以很容易的找到自己所需要的资料。在这一系列的过程中,Google遇到的争议的焦点是其复制行为能否构成合理使用。本文在深入分析Google数字图书馆案例的基础上,详细了剖析了该案中所遇到了法律问题,寻找其中的矛盾焦点,再结合国内的立法概况,进而提出合理的解决方案。本文的写作思路如下: 第一部分详细介绍了Google数字图书馆产生的背景,遇到的纠纷及在世界各地诉讼情况。通过对背景的介绍,让我们对该公司所遇到的法律问题有一个明晰地掌握。第二部分主要是对数字图书馆的概念和特征作一界定。因为要对整个案件进行解析的话,首先必须对Google公司的行为进行认定。若Google公司的搜索引擎不属于数字图书馆,那么之后所讨论内容也就没有太大的意义。通过对数字图书馆的定义、特征分析,最终认定Google的搜索引擎属于数字图书馆的范畴。第三部分是对Google数字图书馆案所涉及的知识产权问题进行分析。在第二部分对Google数字图书馆认定的前提上,对其所涉及的复制权和信息传播权进行了分析,并且把问题的焦点集中到合理使用问题上。第四部分对合理使用的不确定性进行分析。合理使用的目的和意义是在于保护知识产权的同时,促进知识和文化的传播。网络环境下的产生的新问题使传统的合理使用制度变的模糊不定,因此有必要对合理使用进行重新的架构。第五部分是针对数字图书馆发展遇到的法律问题所提出的一些建议。分别从网络立法、保护模式、合理使用、许可及授权五个问题上进行立法建议和创新考虑,以期达到解决数字图书馆建设中的知识产权问题。
[Abstract]:The digital library represents the future development direction of the library, which brings great vitality once it comes out. In order to seize the latent profits, many enterprises inject high funds in order to get rich returns. Due to the great difference between the digital library and the traditional library in the process of information collection and dissemination, the digital library has encountered a lot of copyright problems in the process of construction. These problems have become the bottleneck of restricting the development of digital library. The construction of Google digital library is one of the typical cases. During the construction and operation of Google digital library, a large number of documents have been copied without the permission of the obligee. After the copy was completed, the company used technology to create the index, Make it easy for readers (users) to find the information they need. In this series of disputes, the focus of the controversy is whether the replication behavior constitutes a reasonable use. This paper analyzes the Google digital map in depth. On the basis of the library case, This paper analyzes the legal problems encountered in the case in detail, looks for the contradictory focus, and then combines the general situation of domestic legislation, and then puts forward a reasonable solution. The writing ideas of this paper are as follows:. The first part introduces the background, disputes and litigation situation of Google digital library in detail. Through the introduction of background, let us have a clear grasp of the legal problems encountered by the company. The second part is mainly to define the concept and characteristics of digital library. Because in order to analyze the whole case, we must first identify the behavior of Google Company. If the search engine of Google Company does not belong to the digital library, Through the definition and characteristic analysis of digital library, it is concluded that the search engine of Google belongs to the category of digital library. The third part is the analysis of the intellectual property rights involved in the Google digital library case. In the second part, on the premise of the recognition of the Google digital library, the author analyzes the rights of reproduction and information dissemination involved in the Google digital library. And the focus of the problem on the rational use of the problem. The fourth part analyzes the uncertainty of rational use. The purpose and significance of rational use is to protect intellectual property rights at the same time. Promoting the dissemination of knowledge and culture. The new problems arising in the network environment make the traditional rational use system fuzzy and uncertain, so it is necessary to reframe the rational use system. The fifth part is to put forward some suggestions on the legal problems encountered in the development of digital library. From the network legislation, protection model, reasonable use, licensing and authorization of five issues of legislative advice and innovative consideration, In order to solve the problem of intellectual property in the construction of digital library.
