国际文本与数据挖掘版权新策解析及启示

【摘要】：【目的】探究国际文本与数据挖掘(Text and Data Mining,TDM)版权新策对我国科技期刊的启示。【方法】梳理TDM在国际立法界、司法界以及出版商界的发展动态,归纳国际TDM版权新策特征。【结果】TDM符合鼓励创新的版权立法宗旨,在国际立法界、司法界以及出版界得到广泛梳理,并获得不同程度及不同方式的认可。【结论】科技期刊界应当积极梳理TDM的国际发展动态,厘清其法理本质,夯实相关行业政策联盟,在国际合作谈判中主动嵌入相关合理使用许可谈判,并且考虑加强与技术产业界合作,联合建立国内科技期刊数字平台,为科研人员开展TDM合理使用提供坚实支撑。
[Abstract]:[objective] to explore the implications of the new copyright policy of text and Data mining (TDM) for Chinese sci-tech journals. [methods] to analyze the development of TDM in the international legislative, judicial and publisher circles.The characteristics of the new copyright policy of international TDM are summarized. [results] TDM accords with the aim of encouraging innovation in copyright legislation, and has been extensively combed out in the international legislative, judicial and publishing circles.And get different degrees and different ways of recognition. [conclusion] the scientific and technological journals should actively comb the international development of TDM, clarify its legal nature, consolidate the relevant industry policy alliance,In the international cooperation negotiation, we should take the initiative to embed the relevant reasonable use license negotiation, and consider to strengthen the cooperation with the technology industry, and jointly establish the digital platform of the domestic sci-tech periodicals, which provides a solid support for the scientific research personnel to carry out the rational use of TDM.
