我国数字出版版权保护研究

【摘要】：数字出版方兴未艾，版权保护问题是其发展的瓶颈之一，直接影响到数字出版的赢利、版权人利益的保护和参与的积极性，间接关系到我国知识产权保护体系的完善、知识经济的发展与文化软实力的提高。目前，，我国数字出版版权保护在授权、法律保护以及如何应对新技术带来的挑战等方面都存在着问题。基于以上关于挑战与问题的分析，笔者认为，要保护数字出版版权，须探索多样化的授权方式；修订和完善我国现行的《著作权法》，并根据国情适当提高版权法的国际适用度；对技术保护措施的使用，应找到版权人和使用者的利益平衡点；要加强数字出版版权保护的行政执法力度，充分发挥政府职能。
[Abstract]:Digital publishing is in the ascendant. The problem of copyright protection is one of the bottlenecks of its development, which directly affects the profit of digital publishing, the interest protection and participation enthusiasm of copyright owners, and indirectly relates to the perfection of intellectual property protection system in China. The development of knowledge economy and the improvement of soft power of culture. At present, there are some problems in copyright protection of digital publishing in China, such as licensing, legal protection and how to deal with the challenges brought by new technology. Based on the above analysis of the challenges and problems, the author believes that in order to protect digital publishing copyright, it is necessary to explore various ways of authorization, revise and perfect the current copyright Law of our country, and appropriately improve the international applicability of copyright law according to the national conditions. In the use of technical protection measures, the interests of copyright owners and users should be balanced, and the administrative law enforcement of digital publishing copyright protection should be strengthened to give full play to the functions of the government.
