【摘要】：随着数字信息技术的发展,出版业由传统出版向数字出版转型,文明逐渐开始通过数字形式进行保存,因此传统的出版物呈缴体制已经跟不上数字时代的发展,数字呈缴制度的建立变得十分重要。传统出版物的呈缴状况原本就不乐观,数字出版物的呈缴状况更是不尽人意,出版物数字呈缴制度的建立初衷是为了弥补原有呈缴制度的弊端,不仅需要从法律法规上进行完善,建立以法律为支撑的制度保障,细化法律对于数字呈缴制度的内容建设,制定相关法律保证数字呈缴制度顺利实施,还需要平衡受缴主体和呈缴主体等各方利益,建立补偿机制,集中对于出版物数字呈缴管理的权利,避免各自为政的现象,更是需要在呈缴方式上进行大突破,将原本阻碍呈缴制度发展实施的直接送缴式呈缴方式转变为通过出版物数字呈缴网络平台进行呈缴,可以实现快捷、方便、全面的出版物呈缴,同时为出版物的后续获取利用提供了更好的基础。全文共分为五个章节,第一章为绪论,主要介绍研究缘起以及原有呈缴制度国内外研究现状。第二章对出版物数字呈缴的概念界定,论文通过对出版物呈缴主体、客体及出版物呈缴制度建设历程进行论述,从而明确出版物数字呈缴的内涵;并对传统出版物和数字出版物的数字呈缴进行了概述。第三章主要对我国建立数字呈缴制度的宏观环境进行分析,我国缺乏完善的呈缴法律制度以及对呈缴后出版物版权保护的相关法律,国家财政对于呈缴机制保存管理成本以及受缴补偿成本的经济支撑匮乏,呈缴管理机构管理制度不完善,出版物数字呈缴受缴、保存以及服务利用等环节的相关技术保障存在困难。第四章为我国建立出版物数字呈缴制度的策略,政治方面主要是建立以法律为支撑的制度保障,细化法律对于数字呈缴制度的内容建设以及制定相关法律保证出版物数字呈缴制度顺利实施;经济方面一是节约管理成本,二是实行补偿机制;社会方面的策略首先是国家层面上精简数字呈缴管理者,其次是地方层面遵循国家统一规定,最后是针对数字呈缴的特点进行专门的呈缴管理规定或建立相关管理项目。技术方面主要对出版物数字呈缴平台的建立提出建议。第五章对前文进行总结,并提出对未来公共借阅权和网络信息传播权研究的展望。

The status of the collection of traditional publications is not optimistic, The present situation of the digital publication is not satisfactory. The original intention of the publication system is to make up the defects of the original system. It not only needs to be perfected from laws and regulations, establish the system support with law as the support, and refine the construction of the law for the content of the system of the digital presentation, and make the relevant legal guarantee figures. The payment system is implemented smoothly. It also needs to balance the interests of the subject and the subject, establish the compensation mechanism, focus on the right to pay management of the publication figures, avoid the phenomenon of self governance, and also need to make a breakthrough in the way of presentation, and transfer the direct payment and payment method which originally hinders the development of the system.
