【摘要】：数字技术的迅速发展与互联网时代的到来给著作权制度带来了巨大的挑战,由于作品可以被转化成为数字形式轻易的通过网络被传播与复制,这使得使用者足不出户就可以轻易的获得全球各个地方的任何数字内容,著作权人的利益受到严峻的考验。权利人为了保护自身的权利不被侵害,便开始在网络上与数字作品上使用各种各样的著作权技术保护措施,以限制使用者在未经授权的情况下接触作品、使用作品。科技的发展是一把双刃剑,它能够让著作权人更好的采用技术措施保护自己的权益,也能够让使用者创造出更多的规避与破解技术保护措施的方法与设备。因此,很多国家都开始对技术措施进行法律层面的保护。然而,在立法过程中由于太着眼于保护著作权人的合法权益,往往容易将社会公众的利益与合理使用忽略。目前,著作权的扩张已经达到了亘古未有的地步,这打破了权利人与社会公众之间的利益平衡。数字环境下应该怎样更好的保护与限制著作权技术保护措施制度进而达到一个新的平衡状态,是多数学者所关注的问题。由于经济全球化的发展与知识经济时代的到来,使得国际贸易与著作权产业有着愈来愈密切的关系,国家所拥有的著作权的数量与质量成为该国的一种竞争优势。各个国家都纷纷开始发起成立多边自由贸易协定,而著作权技术保护措施制度更是其中的重要部分。本文是从技术措施的基本概念展开讨论,首先对著作权技术保护措施的基本理论进行阐述,介绍在数字时代中技术措施的新的概念,分析其基本的内涵;其次对国内外与著作权技术保护措施相关的法律制度进行分析与对比,主要阐述国际条约与国外立法,例如美国、日本以及欧盟的技术措施立法情况;再者探讨我国著作权技术保护措施制度的相关立法,分析《著作权法修订草案(送审稿)》相比现行著作权的改变与进步,并且通过对比分析欧美的相关法律制度,总结出各个国家的共性,以便给我国目前的立法给出适当的建议与启示;最后针对技术措施的负面情况,比如阻碍到了社会公众的自由表达与合理使用,进行深度的反省,重点讨论在数字时代如何更好的平衡权利人与社会大众的利益,对完善我国《著作权法修订草案(送审稿)》给出科学的建议。
[Abstract]:The rapid development of digital technology and the arrival of the Internet era have brought great challenges to the copyright system, because works can be converted into digital forms and easily disseminated and copied through the network. This makes it easy for users to gain access to any digital content in every part of the world without leaving home, and the interests of copyright owners are severely tested. In order to protect their rights from being infringed, the obligee began to use a variety of copyright technology protection measures on the network and digital works, in order to restrict the users from having access to the works and using the works without authorization. The development of science and technology is a double-edged sword, it can make copyright owners better adopt technical measures to protect their rights and interests, but also enable users to create more methods and equipment to circumvent and crack technical protection measures. As a result, many countries have begun to protect technical measures at the legal level. However, due to too much attention to protecting the legitimate rights and interests of copyright owners in the legislative process, it is easy to ignore the interests and rational use of the public. At present, the expansion of copyright has reached an unprecedented stage, which breaks the balance of interests between the obligee and the public. How to better protect and restrict the copyright technology protection system in the digital environment and then reach a new balance state is the problem that most scholars pay attention to. Due to the development of economic globalization and the arrival of knowledge economy era, international trade and copyright industry are more and more closely related. The quantity and quality of copyright owned by the country has become a competitive advantage of the country. All countries have initiated the establishment of multilateral free trade agreements, and the copyright technology protection system is an important part of it. In this paper, the basic concept of technical measures is discussed. Firstly, the basic theory of copyright technical protection measures is expounded, the new concept of technological measures in the digital age is introduced, and its basic connotation is analyzed. Secondly, it analyzes and compares the legal systems related to copyright technology protection measures at home and abroad, mainly expounds the international treaties and foreign legislation, such as the United States, Japan and the European Union's legislation on technical measures; Furthermore, it probes into the relevant legislation of the system of copyright technical protection measures in our country, analyzes the change and progress of the revised draft of copyright Law compared with the current copyright system, and analyzes the relevant legal systems in Europe and the United States through a comparative analysis. Summing up the commonalities of various countries in order to give appropriate suggestions and revelations to the current legislation of our country; finally, aiming at the negative situation of technical measures, such as obstructing the free expression and rational use of the public, conducting in-depth reflection. This paper focuses on how to better balance the interests of the obligee and the public in the digital age, and gives some scientific suggestions on how to perfect the revised draft of copyright Law in China.
