编剧权利保护:中国现实与未来

【摘要】:在影视产业的链条中,编剧处在源头。在一定意义上说,没有编剧,就没有好的剧本,也就不可能有好的影视剧。唯有保障好编剧的权益,才能激发编剧创作好剧本的动力。中国编剧权利受侵的情况屡见不鲜,维权显得迫在眉睫。首先,在影视产业链条中,编剧是其中的劳动者,其劳动应受到劳动法的保护。如果编剧的权利得不到有效的保护,出现了类似美国那样的编剧罢工,就会威胁到影视产业的市场秩序,造成影视产业不安定的局面。其次,在理念上,我们应当确立与制片方之间的劳资关系的属性。在确立了这一理念后,编剧就是劳动者。最后,编剧权利是著作权保护的重要内容。著作权可以保护著作权人的权益,激发其创作积极性。著作权对促进经济、科技的发展和文化、艺术的繁荣起了重要作用。然而,随着时代的进步,科学技术的更新,新型的作品形式不断涌现,如何实现“旧瓶装新酒”,把新型的作品纳入到著作权法保护的范围之内,需要法律的智慧。中国编剧署名权、保护作品完整权和最基本的报酬权普遍受到侵害。这些问题在美国并不普遍,可以说是基本解决了。本文将借鉴美国的治理办法,结合中国的实际,从行业和法律两个角度提出中国编剧维权策略。另外,关于中国编剧和美国编剧想要随着新媒体时代发展,获得与自己劳动完全匹配的报酬,由于立法的滞后性和不全面性,这个问题只能是完善,不能完全解决。
[Abstract]:In the chain of film and television industry, the screenwriter is at the source. In a sense, there is no screenwriter, no good script, there can be no good film and television drama. Only by protecting the rights and interests of screenwriters, can we inspire the writers to write well. The violation of Chinese writers' rights is common and urgent. First of all, in the chain of film and television industry, screenwriter is the laborer, whose labor should be protected by labor law. If the rights of screenwriters can not be effectively protected, there will be a strike like that in the United States, which will threaten the market order of the film and television industry and cause instability in the film and television industry. Secondly, conceptually, we should establish the attributes of industrial relations with producers. After establishing this idea, the writer is the laborer. Finally, the writer's right is an important part of copyright protection. Copyright can protect the rights and interests of copyright owners and stimulate their creative enthusiasm. Copyright plays an important role in promoting the development of economy, science and technology and the prosperity of culture and art. However, with the progress of the times, the renewal of science and technology and the continuous emergence of new forms of works, how to realize the "new wine in old bottles" and bring the new works into the scope of copyright law protection needs the wisdom of law. The right to authorship, the right to integrity and the most basic right to remuneration are generally violated in China. These problems are not common in the United States, can be said to be basically solved. This article will draw lessons from the American governance method, unifies the Chinese reality, from the industry and the legal angle puts forward the Chinese screenwriter rights protection strategy. In addition, with the development of the new media era, the Chinese and American writers want to get the remuneration that matches their own labor perfectly. Because of the lag and imperfection of legislation, the problem can only be perfect and can not be solved completely.
