数字作品出版中的版权保护问题

【摘要】：本文从谷歌数字图书馆计划遭遇的版权争议等当前知名数字作品出版著作权纠纷案例入手,分析造成这些纠纷的原因。在此基础上探讨国外数字作品出版版权保护的相关制度与经验,并对完善我国的相关法律制度提出建议。在写作过程中,本人将采用案例分析、文献研究、比较分析的方法探讨相关问题。全文除了“引言”和“结语”外,分为四个部分：第一部分,介绍谷歌的数字图书馆在各国遭遇的版权争议,引出当前在数字作品出版中版权制度受到挑战的事实。第二部分,数字作品出版领域版权问题的原因分析。数字出版引发出版领域法律关系的变革,诱发了新类型的版权纠纷,而数字技术对传统版权平衡的挑战则是数字作品出版版权问题的根源。第三部分,介绍国外处理数字作品出版中版权保护问题的相关制度和经验。为应对数字技术的挑战,在复制权的界定与限制、技术保护措施、版权补偿金、网络服务提供者的侵权责任等方面,世界知识产权组织及美国、欧盟的版权法均做了相应的调整与革新。第四部分,对我国的相关法律制度的分析和建议。我国的版权立法注重与国际接轨,在数字作品出版的版权保护上取得了较大成就。但同时也存在一些问题,我们可以通过完善著作权集体管理制度、适当应用默示许可授权、建立著作权赔偿金制度,协调版权人、数字出版者和社会公众利益,维护著作权的立法精神,建立数字作品出版中著作权保护与知识信息共享的平衡。
[Abstract]:This paper analyzes the causes of the copyright disputes in the publication of well-known digital works, such as the copyright disputes that Google Digital Library plans to encounter. On this basis, this paper probes into the relevant systems and experiences of copyright protection of digital works published in foreign countries, and puts forward some suggestions on how to perfect the relevant legal systems of our country. In the process of writing, I will use case analysis, literature research, comparative analysis to explore the relevant issues. In addition to "introduction" and "conclusion", the full text is divided into four parts: the first part introduces the copyright disputes encountered by Google's digital library in various countries, and leads to the fact that the copyright system has been challenged in the publication of digital works. The second part analyzes the reasons of copyright problems in the field of digital publishing. Digital publishing leads to the reform of legal relations in the field of publishing, which induces new types of copyright disputes, and the challenge of digital technology to the balance of traditional copyright is the root of copyright problems in digital publishing. The third part introduces the system and experience of foreign countries dealing with copyright protection in digital publishing. In order to meet the challenges of digital technology, the World intellectual property Organization and the United States, in the areas of definition and limitation of reproduction rights, technical protection measures, copyright compensation, tort liability of network service providers, The copyright law of EU has made corresponding adjustment and innovation. The fourth part, the analysis and suggestion to the related legal system of our country. The copyright legislation of our country pays attention to the international connection, and has made great achievements in the copyright protection of digital works publication. But at the same time, there are also some problems. We can establish a copyright compensation system by perfecting the collective management system of copyright, appropriately applying implied license authorization, and coordinating the interests of copyright owners, digital publishers and the public. To maintain the legislative spirit of copyright and to establish a balance between copyright protection and knowledge and information sharing in the publication of digital works.
