视频网站盗链行为的著作权侵权分析

【摘要】：互联网技术的变革催生了网络视频行业的蓬勃发展并逐步趋向正版化,但同时也为部分视频网站的"盗链行为"提供了物质基础。设链视频网站通过技术破解措施盗取被链视频网站(正版视频网站)影视资源在自己网站进行无跳转式的直接播放,此类行为极大地损害了被链网站以及著作权人的合法权益,更是破坏了公平有序的市场秩序。但司法裁判却很难根据现行著作权制度与规则规制盗链行为。事实上,可以从一般侵权法体系的侵权四要素角度考量,将盗链行为列入著作权侵权范畴。
[Abstract]:The revolution of Internet technology has given birth to the vigorous development of the network video industry and gradually tends to legalization, but at the same time, it also provides the material basis for the "chain theft" behavior of some video websites. Chain video websites steal the video resources of linked video websites (authentic video websites) through technical measures to directly play video resources without jumping in their own websites. This kind of behavior greatly damages the legitimate rights and interests of the chain websites and copyright owners. It also undermines the fair and orderly market order. However, it is difficult to regulate chain theft according to the current copyright system and rules. In fact, chain theft can be included in the category of copyright infringement from the perspective of the four elements of tort in general tort law system.
