论教辅图书的著作权保护

【摘要】:著作权是指著作权人依法对其创作的作品所享有独占、使用和处理的权利。近年来关于教辅图书著作权的纠纷案件愈演愈烈,尤其是教辅与教材之间的侵权纠纷层出不穷,反映出了我国对教辅图书著作权保护的不足,加强对教辅图书著作权保护迫在眉睫。因此,本文的研究具有重大的理论意义和实践意义。首先,通过本论文的研究,旨在探究教辅拥有的著作权利,从而促进我国知识产权法,尤其是著作权法对教辅图书相应权利的保护。其次,通过本论文的研究,完善关于教辅图书著作权法的法律法规。再次,通过本论文的研究,促进教辅图书维权和教辅图书版权意识的提高。再次,通过本论文的研究,有利于法院在审理案件的过程中,充分考虑教辅图书这一著作权保护的特殊性,为案件的科学审判提供借鉴性的指导。最后,通过本论文的研究,使出版商清晰认知自身权利边界和自身合法性的边界,充分发挥市场竞争机制,促进我国图书业的繁荣发展。本文通过运用文献分析方法、实证分析方法、比较分析方法等研究方法,就教辅图书著作权存在的问题、教辅图书著作权的权利内容、教辅图书著作权的保护措施进行了逐一分析。全文共分为七个部分: 第一部分:引言。从人民教育出版社发表的一段声明引出教辅图书著作权保护的迫切性和必要性。 第二部分:教辅图书的著作权纠纷。通过对“北京仁爱诉中学教辅-案”的评析,探究教轴图书与教材的著作权关系。 第三部分:教辅图书著作权保护中存在的问题及症结。分析了当前教辅图书著作权保护中面临的一些问题及产生这些问题的原因。 第四部分:教辅图书著作权保护的权利基础。揭示了教辅图书的法律属性和教辅图书著作权的产生。 第五部分:教辅图书的著作权保护。阐述了教辅图书的权利内容和各个权利主体拥有的著作权利。 第六部分:对教辅图书著作权保护的完善。笔者针对教辅图书著作权保护中的不足,提出了教辅图书著作权保护的一些措施。 第七部分:结语。笔者期待教辅图书的著作权保护在今后的立法和司法实践中取得长足的发展。
[Abstract]:Copyright refers to the copyright owner's exclusive right to use and deal with the works he creates according to law. In recent years, the disputes about the copyright of teaching auxiliary books are becoming more and more serious, especially the infringement disputes between teaching aids and teaching materials emerge in endlessly, which reflects the deficiency of copyright protection of teaching auxiliary books in our country. It is urgent to strengthen the copyright protection of teaching auxiliary books. Therefore, the study of this paper has great theoretical and practical significance. First of all, through the research of this paper, the purpose of this paper is to explore the copyright rights of the teaching aids, so as to promote the protection of the corresponding rights of the teaching auxiliary books in China's intellectual property law, especially the copyright law. Secondly, through the study of this paper, improve the copyright law of teaching-assisted books laws and regulations. Thirdly, through the research of this paper, it promotes the rights protection and copyright consciousness of teaching auxiliary books. Thirdly, through the research of this paper, it is helpful for the court to consider the particularity of the copyright protection of teaching auxiliary books in the process of hearing cases, and to provide reference guidance for the scientific trial of cases. Finally, through the research of this paper, the publishers can clearly understand the boundary of their own rights and their own legitimacy, give full play to the market competition mechanism, and promote the prosperity and development of China's book industry. By using the methods of literature analysis, empirical analysis, comparative analysis and other research methods, this paper discusses the problems existing in the copyright of teaching auxiliary books, and the content of copyright rights of teaching auxiliary books. The measures to protect the copyright of teaching auxiliary books are analyzed one by one. The full text is divided into seven parts: the first part: introduction. From a statement issued by the people's Education Publishing House, the urgency and necessity of copyright protection for teaching auxiliary books are drawn. The second part: the copyright dispute of teaching assistant books. Through the analysis of Beijing benevolence v. secondary school teaching aid case, this paper explores the copyright relationship between teaching books and teaching materials. The third part: the problems and sticking points in the copyright protection of teaching-assisted books. This paper analyzes some problems in the copyright protection of teaching auxiliary books and the reasons for these problems. The fourth part: the right foundation of copyright protection of teaching auxiliary books. It reveals the legal attribute of the teaching assistant books and the creation of the copyright of the teaching auxiliary books. Part five: copyright protection of teaching assistant books. This paper expounds the content of the right of teaching auxiliary books and the rights of each right subject. The sixth part: the perfection of copyright protection of teaching auxiliary books. Aiming at the deficiency of copyright protection of teaching auxiliary books, the author puts forward some measures to protect the copyright of teaching auxiliary books. Part seven: conclusion. The author expects the copyright protection of teaching auxiliary books to make great progress in legislation and judicial practice in the future.
