18世纪英国出版管制研究

【摘要】: 1694年,许可证法的废止,是英国资产阶级向废除检查制度、实现出版自由迈出的重要一步,英国的作家和出版商从此享有出版前免受检查的自由,它标志着源于宗教法院的传统的出版许可制开始瓦解,却并不标志着出版自由时代的到来,进入18世纪,英国同时采取经济手段和司法手段对出版进行管制。本文将主要探讨:从“光荣革命”到18世纪末,“知识税”法案产生的原因以及不断加强的过程;补贴制度产生的原因以及逐步走向瓦解的过程及原因;管制出版的司法措施煽动诽谤罪的审判原则最终确立的过程。 本文除引言和结语以外共分三部分: 第一部分:征收“知识税”。这部分内容包括第一个“知识税”法案产生的原因及其影响;探究政府为了强化“知识税”连续提高税率的过程及原因。 第二部分:实行补贴制度。这部分内容包括在整个18世纪英国实行补贴制度的原因及其过程;18世纪末期补贴制度瓦解的原因。 第三部分:煽动诽谤罪。这部分主要探究煽动诽谤罪审判原则的变化,以及发生这种变化的原因。
[Abstract]:In 1694, the abolition of the permit Act was an important step by the British bourgeoisie towards the abolition of censorship and the freedom of the press, from which British writers and publishers enjoyed freedom from censorship before publication. It marks the beginning of the disintegration of the traditional publishing licensing system originated from the religious courts, but not the arrival of the free press era. In the 18th century, Britain adopted both economic and judicial means to regulate the publication. From the glorious revolution to the end of the 18th century, the causes of the "knowledge tax" law and the process of its continuous strengthening, the causes of the subsidy system and the process and causes of its gradual disintegration will be discussed in this paper. The process by which judicial measures to regulate publication of seditious libel are finally established. This paper is divided into three parts except introduction and conclusion: the first part: levying knowledge tax. This part includes the causes and effects of the first "knowledge tax" Act, and explores the process and reasons for the government to increase the tax rate continuously in order to strengthen the "knowledge tax". The second part: implement subsidy system. This part includes the reasons and the process of implementing subsidy system in England in the whole 18th century, and the causes of the collapse of subsidy system in the late 18th century. Part three: seditious libel. This part mainly explores the change of the principle of seditious libel trial and the reasons for this change.
